RESOLVED, by the City Council of the City of Cupertino, CaliEornia, that
' WIIEREAS, Ehe ra[es for s[reet lighting charged by utilities governed by [he
j California Publlc Utilities Commission do no[ reflect [he actual energy used by
~ the s[reet ligh[s; and
~ WHF.RF.AS, local agencies are discouraged from acquiring the components of the
' utility-owned street light system because procedures for acquisition of the components
I, are vague and unnecessarily cumbersome; and
WfIEKEAS, joint-tenancy of utility poles have been discouraged or conditioned
' in such a manner as to be unfeaslble; and
WIIEREAS, utilities' rate structure adjusted and approved by the Commission
from time to time included provisions for the amortization of u[ili[ies' installation
and replacement costs of s[ree[ ligh[ing facili[ies; and
I.~ICREAS, utilities' method of evaluating its stree[ lighting facilities
(Reproduction Cost New Less Depreciation) does not reflec[ [he actual saleable
worth of these facili[ies; and
lJIl1:RF.AS, utilities require local public aRencies to purchase street lighting
facilities which were previously installed by property owners and developers and
[hen dedicated a[ no cost to the utilities;

is requeGted to consider, amend and adopt regulations governing and regulating
street ligh[ing which would provide [hat;
1. Rates charged for street lip,hting reflect the actual energy used by
the li~hts; and
2. Procedures Eor acquiring components of the u[ili[ies' s[reet lighting
sys[em be sta[ed in a clear and precise manner; and
3. Otilities be required, if requested by a local Public A~ency to allow
~otnt u5e of their u[ilitV pole system, without charFe, to ins[all Rtreet light
fix[ures owned and main[ained by the local public agency; and
4. The method utillzcd by utilities for valuati~g street ligh[inF Eacilities
to be purchased by public entities be based on actual cos[ oE the fncilities
~.ahen installed less depreciation and any other amoun[s recovered through utility
rlte charges, not to exceed salvage value; and

• S. Utilities be required, if requested by a Local public agency, to
transfer to the agency, without charge, any s[reet lighting Eacility which
u[ilities acquired from property owners and developers at no cost to [he utility.
