CC Resolution No. 5685 ~ s • ~ RESOLUTION N0. 5685 ~ ~ A RESOLUTION OF THE CITY COUNCIL OF TRE CITY OF CUPERTINO CERTIFYING REVIEW AND CONSID~:RATION OF ENVIRONMENTAL IMPACT REPORT: TIARIANI GROUP OF CO.HFANII:S, "T_HE VILLAS AT LAKE MARIANI" WkiEREAS, the Mariani Group of Comparties ~roposea to have conatructed a 533 unit rasidential planned development 2ocated on 18.5+ acres on the South- ~ east corner of the intersection of De Anza Boulevard and llomestead Road ("The Villas at Lure Mariani"); and _ WkiEREAS, the Mariani Group ~f Companies has had prepared and submitted to the City for review the Environmental Impact Report pertgining to tliis property; and WHEREAS, the final Environmental Impact ~eport was reviewed in con~unction I with the Public Hearings for rezoning Application 8-Z-81 and Use Permit ~ Application 27-U-80; and WNEREAS, the aignificant effects of the project identified in the Environ- mental Impact Report have been mitigated by the following plan changes and I development conditions of approval: SIQJIFICANT EFFECT MITICATION MEASURE ' A. Noise Condition 24 of Planning Commission Resolution 2226 requires special acouatical treatment to ' comply with Title 25 standards. Condition 24 also requires [he applicant to retain an acoustical consultant to aseure compllance during the construction phase of the development. Measurea ahould be implemented to reduce pro,ject . construction noise. Such measures include properly tuned equipment, construction durinp, daytime hours only (8:00 a.m, to 5:00 p.m.), and the uae of temporary noise barriers. B. Urban Deeigit The site plan was mOdified [o include r~ore functional recreation areas for residents and eatablish maximum building heights and buildin~ materials to create harmony with ad~oining ' Northpoint development. Condition 23 of Plan- ning Commiasion Resolution 2226 was imposed to require a deteiled ArcM tectural and Site Approval Cosnittee review of the perir~eter landscaping to create visual intereats as viewed from public roadways. The project has incorporated design consideratlons including modulated shapes, under- ground parking, berms and staggered wall on the periphery, texture oi materials to bring the development in concert with other pro~ects in : Cupertino. ~ ~ • C. Traffic and Circulation Condition 16 of Planning Commission Resolution , 2226 requires the applicant to construct a significant amount of off-site road work to mitigate traffic congestion associated with the development. The site plan was modified to create safe left-turn access into and out of the project from Blue Jay Drive. D. Sewage Diaposal The aite plan will be graded in a ~nanner to easily diatribute effluent to sewer mains paralleling Homestead Road and 280 Freeway. In terms of the treatment plant capacity, data from the Cupertino Sanitary District and the Santa Clara/San Jose Treatment Plant operators indicate that sub~ect development will not overtax the Sanitary Districts projected allot- ment at the time the unit will be occupied. Water conservation kits will be included with each unit. In its current general plan land use studies, which are con3lderin~ inereasing, decreasing, and retaining existing plan densities, the City ahall consider the relationship between the densities permitted on undeveloped properties between Homestead Road and the freeway, and t}~e remaining capacity of the associated sewer mains. The City ahall continue to monitor the efforts of the Water Pallution Control Plant to expand capacity in phase with development. Should plant capacity not be expanded by the stated completion date, conaideration shall be given to phasing pro~ect development in conjunction with other areawide development to avoid overcapacity at the treatment plant. E. Energy Conaervation Condition 22 of the Planning Commission Resolution No. 2226 requires the installation of solar assiated hot water heatins syatems to serve all units. The aite plan was modified to provide a bus turn out to encourage the use of transit. The developmen[ includes overhangs and shading to reduce solar impact. NOW, THEREFORE, it is hereby found, determined and ordered that the City Council of the City of Cupertino, as reaponsible agency, has considered said Environmental Impact Report and hereby certifies that it has reviewed and considered the information contained therein and that [he Environmental Iapact Report has been completed in compliance with the CEQA and State guidelines. Council finds further that alterationa have been incorporated into the project which mitigate or avoid each eignificant environmental impact identified in the Environmental Impact Report to an acceptable level as defined in 5ection 8.7 of the Cupertino Environmental Guidelines.
