RESOLUTION N0. 5671 A RESOLUTION OF TNE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING RESOLllTION 5214 APPOINTING TNE CITY ATTORNEY, I ASSISTANT CITY ATTORNEY AND DEPUTY CITY ATTORNEY, DES- I CRIBING THEIR DUTIES AND PROVIDING FOR THEIR COTiPEN5ATI0N The City Councii of [he City of Cupertino resolves as follows: i Section 8. Retuiner amended: Section8 of Resolution No. 5214 is amended [o read as follows: The City Attorney shall receive a mon[hly retainer from the Ci[y in the sum of Two Thousand Six f{undred Eighteei~ Dollars ($2,618.00) which shall be considered full compensation for the purE~~se of contributions and withholdings ~ with respect to retirement, social security lncome tax withholdings, and i ~ the like. The monthly retainer ahall be puid at the end of each month on the payroll account of [he City. Furthermure, the C1ty shall contribu[e to PERS retirement and health benefits as well as social security in the same amounts it does for resular City employeer. ~ Section 9. Additional Compensation amended: Section 9 of Resolution 5214 is hereby amended to rend as follows: I In addition, the City Attorney shall receive [he following contractual I services compensatfon: (a) Administrative: ~ To the extent that the collective time of the City Attorney, the ~ Assistant City At[orney, and other members of the law firm of the City Attorney, ~ for the performance oE administrative services, exceeda thirty (30) hours . in any one month excluding time spent nt and preparation for regular and special ~ City Council meetings and Pianning Commiasion meetings, the City Attorney shall be entitled to receive additional compensa[ion from the City at the rate of Sixty Dollars ($60.00) per hour. Said hourly rate shall be effective for a period of two (2) fiscai years commencing July 1, 1981. (b) Litigation: ~ The City Attorney ahall receive as compensation for the performance of litigntion services, and for the litigation services of the Assiatant City Attorney, the Deputy City Attorney. and other members of the law firm of [he Ci[y A[torney, compensation at the rate of Sixty Dolltsra ($60.00) per hour. Said hourly rate shall be effective for a period of two (2) fiscal years commencing July 1, 1981. . l ~ .
