A RESOLUTION OF THE CI'TY COUNCIL OF TttE CITY OF CUPERTINO
' ~ ESTABLISfi1NG DIFFERENT CATEGORIES OF STREET Ir1PROVEMENT
REQUIRPIENTS THROUGIIOUT TflE CITY
, l1lIEREAS, the City is considering establishing different categories of
Street improvements; and
' t~ktEREAS, each of the categories established will determine the type of
improvement and [iming of said improvements; and
' WHEREAS, Chapter 14, Section 14.04.090 of the Cuper[ino Municipal Code
requires establishing areas of the City as to which categories oE improvement
will prevail; and ~
WHEREAS, said ordinance requires delineation of the different streets
within categories in the form of a City map; and
' WHEREAS,for the purpose of establishing the type oE street improvements,
urban and rural character will be defined as follows:
' Urban improvements will incl~de all standard Ci[y improvements
including sidewalks and lighting; while rural character will be .
limited to all the standard improvements with the exception of
sidewalks and electroliers.
' W1IEREAS, the attached Exhibi[s A and B, made a Part of this resolution,
delineate the streets within the following street improvement requirement
' categories:
, Cntegory 1 .
Streets tha[ have existing street improvements which have
been uccepted as standard for the area. They may be of either
urban or rural standard. No change or modifica[ion to the
standards will be made. Any improvements that remain to be
installed will be required at the time of issuance of City
permit.

All streets which have the potential of being further improved
because of sufficient number of deferred agreements and/or vacant
lots yet to be developed which would allow for a ma,jority of the
property owners to participate in a viable stree[ improvement
project. All the streets with the exception of the non-residential
areas will fall under the rural character and no sidewalks or li~hts
will be required. The areas othcr than residential will be required
to install the standard street improvements which may include side-
walks and electroliers. The decision of whether to install the im-
provements upon the issuance of permit or defer them will be made by
staff at the time of the application.

~ • Remaining streets that have no potential of being improved
other than in a piecemeal manner on a lot-by-lot basis. No
deferred agreements or standard street improvements will be
imposed. A fee will be collected in lieu of interim improve-
ments to extend the life of the existing pavement.

NOW, THEREFORE, BE IT RESOLVED tl~at the City Council of the City of Cupertino
hereby approves the establishment of different categories of street improvement re-
, quirements as outlined above and approves Exhibit A and H, attached hereto, as the
manner in which streets within the City shall be classified.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this lst day of June, 1981, by the following vote:
