I WHEREAS, hearing on Resolution of Intention No. 5609 was held on
April 20, 1981 a[ a regular meeting of the City Council at 10300 Torre
i Avenue, Cupertino, California; and
WHEREAS, i[ appears that notice thereof was duly given as required by
law; and
W}iEREAS, from the evidence presented, bo[h oral and documentary, it

I appears to be [o the best lnteres[ of the City to vacate the hereinafter
described por[ion of a City street; and that said portion of said City

i street is unnecesslry for present or prospec[ive public stree[ purposes,
bu[ is necessary to be retained as pahlic utility, sanitary sewer, landscape
''I easement, pedestrian, and hicycle easements.
II Wt1EREAS, existing streets are adequate [o handle presen[ and future
projec[ed [raffic; and
1J}iEREAS, vacation is in conformance with [he City's General Plan;
' NOW, THF.REFORF., 8E IT RESOLVED:
1. That all or any protests against [hc vacation of said portion of
, Ci[y street be and here6y are overruled and denied;
2. Tha[ said por[ion of Olive Street ~e5crihed and shown in F.xhibi[s
"A" and "D" a[[~ched heretn and made part hereof, be and {iereby is vacated,
' bu[ is retatned ae public utili[y, sanitary sewer, l~ndscape, pedestrian and
' bicycle easements.
3. That the vacation shall be effective upon completion of [he construction
' of the street improvements.

That [he City Clerk be and hereby is instructed and directed to cause a
certified copy of this resolution, attested [o and sealed with the Officlal Senl
