CC Resolution No. 5618 W • ~ RESOLUTION N0. 5618 A RESOLUTtON OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ORDERING VACATLON OF A PORTTON OF A PUBLIC UTIi.ITY AND SANITARY SEWER EA5EMENT WITHIN THE CIT'ti' OF CUPERTINO PURSUANT TO SECTION 50430 OF THE GOVERNMENT CODB OF THE STATE OF CALIFORNIA; LOCATED BETWEEN COMPION BOUNDARY LINE ' OF LOTS 2 AND 3, TRACT 5990, RAINSOId'S EP7D WHEREAS, heartng on Resolution of Intentian No. 5587 was held on ' April 6, 1981, at a regular meeting of [he City Council at 10300 Torre Avenue, Cupertino, California; and WIiEREAS, it appears that notice thereof was duly given as required by law; and I I,iHEREAS, from the evidence presented, both oral and dacumentary, 1t i appears to be to the best interest of the City to vacate the hereinaf[er described portion of Public Utility and Sanitary Seuer easement; that said portion of aforementioned easemen[ is unnecessary for present or prospective public purposes; NOW, THEREEORE, BE IT RESOLVED: 1. That all or any protes[s against the vacation of said portion of Public Utility and Sanitary Sewer easement be and hereby are overruled and denied; ! 2. That that certain portlon of Public Utility and Sanitary easement described ~ and shown in Exhibtts "A" and "B" attached hereto and made part hereof, be and I hereby is vacated.
