A RESOLUTION OF THE CITY COUNCIL OF TIIE CITY OF CUPERTINO
ORDERING VACATION OF A PORTION OF STEV~NS CREEK BOULh'VARD
AT CARMEN ROAD AS PROVIDED IN SECTION 8320 ET SEQ. OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, RE-
TAINING IT AS PUBLIC SERVICE EASEMENT AND A PORTION AS A
TEIiPORARY RIGHT-OF-WAY EASEMENT
WfIEREAS, hearing on Resolution of Intention No. 5460 was held on November
3, 1980 at a regular meeting of the City Council a[ 10300 Torre Avenue, Cuper-
tino, CaliEornia; and
WHEREAS, it appears tliat notice thereof was duly given as required by
i~ law; and
WHEREAS, from the evidence presented, both oral and documentary, i[
appears to be to the best interes[ of the City to vaca[e the hereinafter des-
~ cribed portion of a City street; and that said portion of said City street
' is unnecessary for present or prospective public s[reet purposes, but ia necessary
to be retained as Public Service Easement and a portion as a[emporary Right-
of-Way Easement; and
WHEREAS, exis[ing s[ree[s are adequa[e [o handle present and future projected
traffic; and
WHEREAS, vaca[ion is in conformance with the City's General Plan;
NOW, TIiEREFORE, BE IT RESOLVED:
1. That all or any protes[s against the vaca[ion of said portion of City
stree[ be and hereby are overruled and denied;
2. That said portion of Stevens Creek Boulevard described and shown in
Exhibits "A" and "B" attached hereto and made par[ hereof, be and hereby is
vacated, but is retained as public service easemen[ and a portion as a temporary
right-of-way easement. Said temporary rigiit-of-way easement shall remain
in full effec[ un[il such time as Stevens Creek Boulevard plan line is fully
implemented.
BE IT FUR'1'HER RESOLVED:
That the City Clerk be and hereby is instruc[ed and directed to cause a
certified copy of tliis resolution, atteated to and sealed with the official
seal of the City, to be recorded with the County Recorder of the County of
Santa Clara, California, forthwith.
