A RESOLUTION OF THE CITY COUIVCIL OF THE CITY OF CUPERTINO
AMENDING THE PAY PLAN UNDGR THG PERSONNEL CODE TO EFFECT
A Cf1ANGE IN DEPARTMEb(TAL ORGANIZATION
WHEREAS, a change in departmental organization has resulted in [he
replacement of the Director of Personnel by a Personnel Officer; and,
WHEREAS. the Pay Plan under provisions of the Personnel Code should
reflect the correct position terminology;
NOW, THEREFORE BE IT RESOLVED that the designation of Dlrector of
Personnel or Personnel Director be amended to read Personnel Officer
in the following named sections of the Pay Plan:

Section 1. Puraose
The purpose of this Pay Plan is to establish salary ranges, schadules
of pay grades t~ whicii c2asses of positions wi11 ba assigned and to provide ior
rates of pay for closses and positions whose imcumbents are patd at an huurly
rate; to pr~vide for the establishment of rates of pay for employees on thei:
initial appointment to City service, :nd fo: the orderly and equitable pro-
gression of employees saithin a salary raiige based on raerit and ler.gth of ser-
vice; :o provide ior incrc.,s~s in salary on pro~otion, decreases in salary on
denotion; and for the nar ~er and occurrences when other increases, decreases,
acid adjustr,.ents in salary may be made.
Section 2. Po11cy
The policy under whi~ti [his Pay Plan is to be ad:ninistered is one
of equitability of pay for duties and responsiUilit?es assigned, cneritorious
service, and comparability with similar caork in otner pu6lic and private
I enploynent in the sao:e labor market; all of which is contiagent upon the
' City's ability t~ pay cor.sistent :+±th its fiscal pc:icies.
Section 3. Admini.atration
The administration of :he P2y Pl.:n is hc_aby :nvested in the Person-
nel Officer subject to policies as cet io:th by ~he Appointi:ig Authoritc.
Sectioa 4. Repea7. of Existinq 3alary P.esolutions
All existing City of Cupertino resolu:±ons and policies, buth ex-
pli.cit and implied, relating co salaries anci wages are tiereby rescinded ar.d
repealed insofar as thcy are in conflic: with this resolution.
Section 5. Ju:isdiction und Cove:a~e
All pos:tions and enployees of the City of Cupertir.o are subject to
the pra~isions of this Pay Pian, except as specifically excluded herein.
Section 5.1. E:cciusions

II Section 6. Schedule of Pay Grades
, The attached schedule oE pay grades, effective the 30th day of
; June, 1971, is hereby made a part of this Pay Plan. On and after this date
all salaries and rates of pay shall Se paid at one of the steps in the Pay
' Grade at which che classificatiun of the position has been assigned, at a
' rate be[ween Step 3 and the u~axi:~uin as authorized by the Appointing Authority
or at an hourly rate as set forth for those classifications not assigned to
' a Pay Grade.
Section 6.1. Weekly-Monthly Rates
The Pay Plan and Schedule of Pay Grades reference to weekly
' salaries is for purposes of convenience in admini.stering the oi-weekly payroll
, system and said reference is interchangeable with the corresponding monthly
' eGuivalent of that weekly salary.
SecL•ion 6.2. Hourly Rates
, RaCes o~ pay for employees not paid a monthly salary shall be
li~ited to the foiloc,ring categories calcula[ed on [he follo~ing basis:

Section 8.2.
On the comnletion of twelve (?21 ;~unths of sa[isfac~orv con-
tinuaus serv+_ce wnile heing paid at Sten 2 of the Pay Grade,esiployees shall
receive an increase in salary to Step 3.
Sectiun 9. Merit Increases
On the completion oi twelve (12) mantlis of continuous ser~~ice ~t~ile
being paid at Step 3 of tne Pay Grade,amployees become eligibla for furthe:
inereases in salcry subject to the following conditiony:
(a) The empluyee's performance in the position shall be such that
it merics compensation above the average of that paid to other
employee~ perE~rming simiiar tas~s.
(b) The ~erit increase shall be reaues[ed by the employee's Depart-
ment Head and shall 6e authorized 'oy the ~lppointing P.u~;~ority.
(c) No merit increase sh:~ll exceed Eive percenf (5.".) of the Steo 3
salaty for the applicabie alassification in any twelve (12)
month period.
(d) Any rea~~if;~unent of an e~ployee frcm h'_s current pesition to a
va~ant position which results in a salar•• being pai3 at or less
than Step 3 of the naw Pay Grade shall require the succ.essful
completion of sa[isfactory continuous servica in the new Pay

Grade at the appropriate step or steps before becoming

Sectien 10. Promotions
~n e~nloyee shall be given an increase in salary at [he time of
receiving a promotion. Such increase shall be to the Step 1 of the Pay Crade
for his new classificatton or to a step ne:ct higner in amount that approxi-
mates but e~ceeds a five percent (SY.) increase in salary if the new Step 1 is
lesser; providing, however, that ao increase shali 'result in a nev salary
above Step 3 of che new pay Grade. Promotional inereases in excess of the
i foregoing may be gran[ed at the discretion of the Appointing Authority.
i Section 11. Demotions
An employee shall be given a decrease in salary at [he time he re-
caives a demution for cause, such decrease shall be'to the same step in the
, lower Pay Grade as the step on which he was paid inmediately prior Co the
! demotion or to Step 3 of the lower Pay Grade if his salary immediately prior
to the de~otion was above Step 3 oF the highcr Pay Grade.
Section 12. Volun~arv Reduccions
An employee who requests and is granted a reduction to a position
in a lower Pay Grade may receive a salary considered appropriate by tne
Appointing Authority proctding such new salary does not result in an increase.
Section 13. Resll~catfons and Reclassifications
1n employee whcse position has been allocated to a new class or
whose classification has been changed to a new Pay Grade shall Se patd at the
same step in the new Pay Grade as the scep on which he was paid imcaedi2tely
prior to the change; or at a rate above Step 3 in the new Pay Grade corres-
ponding in relattonship to the rate above Step 3 in the old Pay Grade at which
he was paid immedtately prior to the change.
Section 14. Transfers
an employee who is transferred from une position to a vacant position
in another ~lassification assigned to the same Pay Crade shall not receive a
change in salary as a result oF such transfer.
Section 15. Ad ustaents
Adjustments in salary may be made by the Appointing .luthority to
correct clerical errors, to msintain equitability oE psy wichin a group of
employees or positions oc for o[lier good and suff:cient reason.
Section 16. Reinstatemcnt and Returns from Leave

Sectio~ 17. Pay Periods
Pay period shall consiat of fourteen (14) caleadar days con~enc:n~
June 30, 1971. Pay days sha31 be Cli~ Frlday immediately follocaing the clos•e
of each pay period; provided, hcwever, that cahen a re~ul~rly scheduled pay
day falls on a holiday observed by the City xs a non-work day for its officers
and employecs, pay da}s sh~ll be the last vork day icsmediately precedinb
sai,1 holiday.
Section 18. Rates of Pay
' All employees subject to tt~is Pay Plan shall be paid at an appro-
pria~c s;eekly rate set forth in the Schedule of Pay Grades for thoir position
title or shall be paid at an appropriate hourly rate as set for[h in Che
, Salary Schedule for their classification. Equivalent houriy rates for aeel:ly

Sec[ion 19. AppointinR authority

Section 20.1. Amendmencs to Salarv Schedule .
Amendments to and modi.fications of the Salary Schedule shali be
accomolished by authorization oi ~he Appoi~ting Authority and the filing of
same with thc City Clerk. ;
Sectton 21. Effective Date '
