RESOLUTION N0. 5432 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING THE MANAGEMENT COMPENSATION PROGRAM TO EFFECT A , CHANGE IN DEPARTMENTAL ORGANIZATION I kHEREAS, there has been created a new department designated by the title of Department of the City Clerk; and wHEREAS, the head of the new department occupies the position titied City Clerk, which ti[le should be reflected correc[ly in the various policies under the Management Compensa[ion Program; and I HHEREAS, the ti[le of Administrative Services Officer, Public irorks Supervisor, and Chief Building Officer have been changed to Assistant I to the City Maaager, Public Horks Superintenden[, and Building Official. ' which should be reflected correctly in [he various policies under the Management Compensation Program; NOI:, THEREFORE, BE IT RESOLVED that the following named policies under the Management Compensa[ion Program which are attached hereto and made a part hereof are amended as shown. I[ is the intent that through this policy ,I and [hose which are adopted or as may be modified or rescinded from time I to time such recognition may be given. Eligibility for inclusion within this Management Compensation Program ' is limited to persons holding positions as management employees, These are as designated by the Appointing Authority and may be modified as , circumstances warrant. ' As defined under Section 2.52.290 of the Cupertino Municipal Code, a , management employee is any empl.oyee having significan[ responsibilities for ! formulating and administering City policies and programs, including but not limited to the Chief Executive Officer and Department Heads; and, any ' employee having authority to exercise independent judgment to hire, transfer, suspend, lay off, recall, promote, discharge, assign, reward or discipline other employees, or having the responsibility to direc[ them, or to ad~ust their grievances, or effectively to recommend such action if in connection with the foregoing, the exercise of such authority is not ' of a merely routine or clerical nature but requires the use of independent ~udgment. POLICY A. Mana~ement Personnel It is CLty of Cupertino policy that eligible persons. o[her than the City Manager, under the Management Compensation Program shall be reimbursed in accordance with the schedules, terms and conditions as aet forth here- in for atcendance a[ conferences, meetings and training sessions as de- fined below for each. It is the intent of this policy to encourage the con[inuing education and awareness of said persons in the technical improvements and innovations !n their fields of endeavor as they apply to the City. One means of implementing this encouragement is through a formal reimbursement achedule for authorized atte~dance at such confer- ences, meetings and training sessions. B. Non-Management Personnel l:hen authorized by a department head, a non-management person may attend ~ a conference, meetins or training sesaion subject to the stated tetms and conditions included herein for each with payment toward or reimburse- ment of certain expenses incurred being limited to authorized actual costs thereof. II. DEFIHTTIONS A. Budgetary Limitations Funding capability for payment toward or reimbursement of expenses incurred for attendance at conferences, meetings and training sessions shall be limited to the amount nppropriated as a line item for each applicable accoun[. B. Conferences A conference is an annual meeting of a work rela[ed organization the membership of which may be held in the name of the City or the individual. C. Local Area A local area is that within an approximate 100 mile radius or two houra ' drive of the City. G. Meetinge ; A meeting is any scheduled function of a work related organization other than an annual meeting and may consist of a luncheon or dinner or a one ' or two day meeting not properly classified as a training session. ; H. Middle Management I The number and designation of middle management personnel shall be those ''I managemenc positions exclusive of department heads as set forth in ~ Policy No. 1 of the Management Compensation Program. ~ I. Traininq Session i ~ A training session is any type of seminar or workshop the attendance at which is for the purpose of obtaining information of a work related nature to benefit the City's operations or to enhance the attendee's capabilities in the discharge of assigned duties and responsibilities. III. REIMBURSEMENT SCHEDULE A Registration Registration fees for authorized attendance at a conference, meeting or training session will be paid by the City. B. Trans~ortation khen an expendltvre is authorized or is eligible for reimbursement, the City will pay transportation costs from the attendee's home to the destination and return on the basis of [he costs for the nearest route by air at air coach fare. Transportation costs also may include limousine or taxi service to and from the attendee's home and the airport or for airport or destination parking charges for personal automobiles so parked when such is used in lieu of travel by air. Use of a personal ( automobile for City business shall be reimbursed at a rate per mile then in effect for such use except in no case shall it exceed air coach ~ fare. i ' Reimbursement for use of a personal automobile on City business within ! a local area will not be made so as to supplemen[ that already being i paid to Chose persons receiving a monthly mileage allowance. i ~
