NORTH OF BOLLIIQGER ROAD BE IT RESOLVED by the Ci[y Council of the City of Cupertino as follows: j WHERGAS, by Resolution No. 5413, a public hearing was called for Monday, October 6, 1980, at tl~e hour of 7:30 p.m. in the Council Chamber in the City ' Hall, Cupertino, California, to ascertain whetlier the ublic necessit health P Y. ' safe[y, or welfare required the removal of poles, overhead wires and associated ' overhead structures, and the underground installation of wires and facilities for supplying electric, cort¢nunica[ion, or similar or associated service, ' within [ha[ certai? area of the City described as lle Anza Doulevard from ' Bollinger Road to a point 500 ft. norch of Bollinger Road. WHEREAS, notice of such hearing has been given to all affected proper[y owners as shown on the last equalized assessmen[ roll and utilities concerned in the manner and for the time required by law; and SJH~REAS, such hearing has been duly and regularly held, and all persons interested have been given an opportunity [o be heard. NO!7, Ti.EP.IiFORE, BIi IT RESOLVED by the City Council of the City of Cuper- [ino tliat, pursuant to Section 14.20 of the Cupertino rtunicipal Code, the abovedescribed area is hereby declared an Underground U[ility Uistrict, and is designated as Underground Utility District I1o. 6 of the City of Cupertino. Attached hereto, marked Exhiui[ ^.1", and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District; F.ESOLV~D, FUP,TFIER, tha[ the City Council does hereby fix October 1, 1981 as [he date on which afEected property owners must be ready to receive underground service, and does hereby order the removal of all Noles, overhead wires and associated overhead structures and ttie underground inscallation of wires and facilities for supplying electric, coimnunication, or similar or associlted service within Underground Otilt[y DistrLct i1o. 6 on or beEore December 1, 1981. RESOLVLD, 'rURTRER, that the City Clerk is i~ereby instructed to notify all affected utili[ias and all persanti ownin~ real pruperty witl~in Under- ' ground Utility Distrtc[ :Io. 6 of the adoption of this Resolution caithin ten (10) days after the da[c of such adoption. Said City Clerk shall Eurtiier notify said property ownera of the necessity that, iE they or any person occupying such property desires to con[inue to receive elec[ric, communic~[ion or other similar or associated service, they or such occupant sha11, by tiie date fixed in this Resolution, provide all necessary facility changes on ti~eir premises so as to receive such service from the lines nf the supplying utility or utilitie~ a[ a new location, suUject to applicahle rules, :egulations and t~riffs ot the reSpecCtve utility or u[ilities on fil~ witf~ the Public li[ilities Commission of the St~te of California.
