RESOLUTION NO. 5357
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
• INITIATINC PROCEEDINGS FOR THE ANNEXATION OF THE ISLAND
DESIGNATED "POPPY DRIVE 80-27", APPROXIMATELY 3.0 ACRES; "
GENERALLY LOCATED ON THE NORTti AND SOUTH SIDE OF POPPY •
DRIVE WESTERLY OF FOOTHILL BOULEVARD
' W1iEREAS, pursuant to Section 35100 of the Municipal Organization Act of
1977 (MORCA), proceedings for an island annexation may be initiated by resolu-
tion of the legislative body of any affected city of any affected county; and
, WHEREAS, said territory is less than 100 acres and is substantially sur-
rounded by the City of Cupertino (Exhibit "A" and Exhibit "B"); and .
WHEREAS, said territory is receiving benefite from the City of Cupertino
' and will benefit further from annexation; and
WHEREAS, the territory is uninhabited and developing and is no[ prlme
agricultural land; and
' WHEREAS, the City Council of the City of Cupertino has approved a Master
Plan for Services for island areas and a Si[e Specific Service Plan for
"Poppy Drive 80-27"; and
WHEREAS, public hearings have been conducted by the City of Cupertino
and the territory has been prezoned;
j NOW, TNEREFORE, BE IT RESOLVED that the City Council of the City of
I Cupertino hereby initiates proceedings for the annexation of the area desig-
;i nated "Poppy Drive 80-27" and requesta that said proceedinge be conducted
i, pursuant to Section 35110 of MORGA.

All that certain real property situate in the County of Santa Clara, S[ate of
. California, more particularly described as follows:
All of Parcel A as shown upon that cer[ain Parcel Map which was filed for record
. in the Office of the Recorder of the County of Santa Clara, State of California
on Eebruary 28, 1972 in Book 297 of Maps, at Page 11 and all of Lots 1-5 and Lo[s
8-12 and all of Poppy Drive as s`~own upon that cextain map entitled "Tract No. 636
' Villa Vista" which map was filed for record in the Office of the Recorder of the
f County of Santa Clara, State of California on August 22, 1949 in Book 24 of Maps,

Beginning at a point on the northwest corner of Parcel A as shown on said Parcel
Map recorded in Book 297 of Maps at page 11, said point intersecting that certain
annexation to the City of Cupertino by Ordinance No. 104 entitled "Stevens Creek
2A" •

~ Thence~•S 89° 40' E 445.79 feet along the northerly boundary of said Parcel A as
shown on said Parcel Ptap and said lots 8-12 as shown on said "Tract No. 636 Villa
' Vista", said line being along said annexation "Stevens Creek Il2A; to a point inter-
secting with that certain annexation to [he City of Cupertino by Resolution No. 1914
entitled "North Foothill 69-8", said point being the noYtfieast corner of said
"Tract No. 636 Villa Vis[a" ae shown on said map;
. Thence S 4° 53' E 308.82 feet along the easterly boundary of said "Tract No. 636
Villa Vista", said 11ne also being the westerly sideline of Foothill Blvd. (For-
merly Mountain View - Stevens Creek Road) as shown on said map, said line being
along said annexation "North Foothill 69-8" to a point being the southeast corner
; of said "Tract No. 636 Vilia Vista", said point interseccing with tha[ certain
annexation to the City of Cupertino by Resolution No. 4941 entitled ''Foothill 79-1";
Thence N 89° 40' W 386.46 feet along the southerly boundary of Lots 1-5 as shown
on said "Trac[ No. 636 Villa Vista", said line being along said annexation "Foothill
19-1" to a point being the southwest corner of Lot 5 as shown on said "TractNo. 63b
Villa Vis[a" said point intersecting that certain proposed annexation to the City of
Cupertino entitled "Poppy Drive 80-12";
Thence N 3° 04' S0" W 113.81 feet along the westerly boundary of said Lot 5 of said
"Tract No. 636 Villa Vista", said line being along said propoaed annexation "Poppy
Drive 80-12" to a point on the cul-do-sac of Poppy Drive;
Thence along a curve to the right along the cul-de-sac of Poppy Drive from a tangent
bearing of S 86~ 55' 10" W, a radius of 40 feet,through a central angle of 142° 38'
07" and an arc length 99.58 feet, said curve being along said proposed annexation
"Poppy Drive 80-12" to a point on the southerly boundary of said Parcel A as shown
on said Parcel Map;
Thence N 89° 40' W 52.12 Eeet along the southerly boundary of said Parcel A as shown
on said Parcel Atap, eaid line being along said proposed annexation "Poppy Drive 80-12"
to a point being the southweat corner of Parcei A as shown on said Parcel Map;
