CC Resolution No. 5284 • RESOLlTTION N0. 5284 • ' A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO i APPROVING THE APPLICATION FOR GRANT FUNDS UNDER TfiE ROBERTI-Z'BERG URBAN OPEN SPACE AND RECREATION PROGRAM WHEREAS, the legislature of the State of California has enacted the Roberti- Z'berg Urban Open-apace and Recreation Program, which provides funds to certain political subdiviaiona of [he State of California for acquiring lands and for developing facilities to meet urban recreation needa. Snd WHEREAS, the State Depar[ment of Parks and Recreation has been delegated the I responsibility for the adminiatration of the program, aetting up necessary procedures governing application by local agencies under the program; and I WtiEREAS, said procedures established by the State Department of Parks and Recreation require the applicant to certify by resolution the approval of applications i prior to submission of said appllcations [o the states; and " , WFiEREAS, said applications contain a certification that the applicant will comply with all federal, atate and local environmental, public health. relocation, affirmative action, and clearinghouse requirements and altogether appropriate codes, laws and regulations prior to the expenditure of the grant funds; and WHEREAS, [he pro~ect(s) applied for under thie program must be of a high priority and sa[isfy the most urgent park and recreation needs with emphasis on unmet needs in the mos[ heavily populated areas; N041~ THEREFORE BE IT RESOLVED that the Cupertino City Council hereby: 1. Approves the filing of an application for funding under the Roberti-Z'berg Urban Open-space and Recreation Program; and 2. Certifies that said agency understands the general provisions of the agreement; and 3. Certifiea that said agency has or w111 have sufficient funds to operate and maintain the project(s) funded under this program; and 4. Cer[ifiea that said agency hae or will have available prior to commencement of any work on the ptoject(s) included in this application matching money from a nonstate source; and 5. Certifies that the project(s) included in this application conform to the recreation element of the applicable city or county general plan; and 6. Appointa Robert W. Quinlan, City Manager as agent of the City of Cupertino to conduct all negotiations, execute and eubmit all documente including but not limited to applicationa, ugreementa, amendmenta, payment requests. and so on Which may be necessary for the completion of [he aforementioned project(s); and 7. Appointe Charles T.
