A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ORDERING VACATION OF A PORTION OF ALHAMBRA AVENUE, LO-
CATED BEIWEEN SANTA CLARA AVENUE AND STEVENS CREEK BOULE-
j~ VARD, AS PROVIDED IN SECTION 8320 ET SEQ. OF TH,E STREETS
' AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA, RETAINING
IT AS PUBLIC UTILITIES F.~ISEMENT AND SANITARY SEWER EASE-
MLT~T
WHEREAS, hearing on Resolution of Intention No. 5209 was held on February
~ 19, 1980 at a regular meeting of the City Council at 10300 Torre Avenue,
, Cupertino, California; and
41HEREAS, it appears thac notice thereof was duly given as required by
law; and
WHEREAS, from the e~idence presented, both oral and documentary, it
appears to be to the best interest of [he City to vacate the hereinafter des-
cribed portion of a City street; and that sai:d portion of said City street
is unnecessary for present or prospective public stree[ purposes, but is nec-
essary to be re[ained as public utilfties easement and sanitary sewer easement.
WHEREAS, existing streets are adequate to handle preaent and future
projected traffic; and
WHEREAS, vacation is in conformance with the City's General Plan;
NOW THEREFORE, BE IT RFSOLVED:
1. That all or any pro[ests against the vacation of said portion of
City atreet be and hereby are overruled and denied;
2. That said portion of Alhambra Avenue described and shoan in Exhibits
"A" a~d "B" a[[ached hereto and made part hereof, be and hereby is vacated,
but is retained as public utilities easement and sanitary sewer easement.
BE IT FURTHER RESOLVED:
That the City Clerk be and hereby is instructed and directed to cause a
certified copy of this Resolution, attested to and sealed with the official
seal of the City, to be recorded with the County Recorder of the County of
Santa Ciara, California, forthwith.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 19th day of February , 1980 by the following vote:
