CC Resolution No. 5227 ~ - s ' RESOLUTION N0. 5227 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ' OF SUPPORT FOR A MOTOR VEHICLE INSPECTION/MAINTII~ANCE ' PROGRAM i ~ WHEREAS, amendmen[s to [he Clean Air Act were adopted by Congress in I 1977 and require in Section 172 the preparation of satisfactory plans [o attaln and main[ain national ambient air quality standards; and I IJHERCAS~ the Association of Bay Area Governmen[s was designated was designated to prepare the Bay Area Air Quali[y Plnn (hereinafter "plan") to meet [he na[ional standards and make [he Bay Area an attainment area; and WNERF.AS, the plan was adopted by the ABAG General Assembly on January 13, ' 1979; and WHEREAS, motor vehicle em:issions are a significant contributor to the Bay Area air quality"problem; and WHEREAS, the plan calls for a motor vehicie inspection and maintenance program to reduce vehicle emissions; and IJHEREAS, the plan finds that [he Bay Area, despite implementation of all reasonably available control measures, canno[ meet the ozone or carbon monoxide standards by 1982; and WHEREAS, [he Clean Air Act provides that nonattainment areas not able to meet the standard by 1982 after implementation of all reasonably available con[rol measures can apply foz an extension to 1987 to meet these standards; and WHEREAS, the ABAC General Assembly has requested an ex[ension of the dead- line for meeting [he ozone and carbon monoxide st~ndards; and WHF.REAS, the Clean Air Ac[ specified [hat EPA can approve this request and the Bay Area plan if a mo[or vehicle inspection and maintenance program is to be implemen[ed in ihe Bay Area; and tJHEREAS, implementation of a motor vehicle inspection and maintenance progr~ in the Bay Area requires enabling legisla[ion by [he California Legis- lature; NOW. THEREFORE, SE IT RESOLVED the the Ci[y of Cupertino believes that a motor vehicle inspection and maintenance program will be a cost-effective method of reducing motor vehicle contributions to [he Bay Area's ozone and carbon monoxide problrms; . s , s BE IT FURTHER RESOLVED that Che City of Cupertino urges the California Legisla[ure to provide adequate statutory authority for the Federally required motor vehicie inspection program for the Bay Aren and other non-a[tainment areas of the Sta[e during the 1980 session of the Legislature; ~ BE IT FURTHER RESOLVED that copies of this resolution be [ransmitted to area Sta[e legislators and ABAG.
