A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
r MAKING APPLICABLE THE PROVISIONS OF THE CALIFORNIA VE-
HICLE CODE TO PRIVATE ROADS WITHZN SROOKDALE ESTATES
• SUBDIVISION, TRACT NUMBER 5821 LOCATED WESTERLY OF AND
ADJOINING FINCH AVENUE
WHEREAS, Brookdale Estates, Subdiviaion, Tract number 5821. located vesterly
I of and ad~oining Finch Avenue. containa privately owned and main[ained roads
II within the City of Cupertino that are not generally held open for use of the
I, pu6lic for purposes of vehicular travel, but, by reason of their proximity
i, to, or connection with highways, the interests of any residents residing
' alang such roads and the motoring public will best be served by application
i of the provisions of the California Vehicle Code to such roads; and
WHEREAS. there was filed with the City of Cupertino a petition reques[ing
such application by a majority of the owners of such privately owned and
maintained roads; and
WHEREAS. a public hearing vith respect to such petition was duly arid
regularly held by the City Council of the City af Cupertino on the 7th day
of January, 1980, after ten (10) days prior writ[en notice to nll owners
of such roads.

NOW, T}iERFORE, BE IT RESOLVED by the City Council of the City of Cuper-
tino, State of California, pursuant to Section 21107.7 of the California
' Vehicle Code, that the provisions of the California Vehicle Code shall apply
i to the privately owned and maintained roads hereinabove described, provided
I appropriate aigns are erected by the property owners a[ the entrance to such
' roads, of such size, ahape and color as to be readily legible during daylight
houra from a distance of one hundred feet (i00'), to the effect tha[ the road
ia aub~ect to the proviaions of [he California Vehicle Code; and
BE IT FURTHER RESOLVED. that the Director of Public Works of the City
of Cupertino is hereby authorized and directed to superviae the erection of
any such signa by the property ownera, as well as any additional aigns which
may be required to be erected in the future. all of which signs shall be
erected by the property owners at [heir aole coat and expense.
BE IT FURTHER RESOLVED. that this resolution may be reacinded and all
signa at the entrances to and upon such roada may be removed by the City
Council of the City of Cupertino, after holding a public hearing after ten
(10) daya written notice to the ownera of such roads, if the City Council
finds and determines that it ia no longer in the interests of any residen[s
residing along such roads and that ihe motoring public ~aill not best be aerved
by application of the provisiona of the California Vehicle Code [o such roads.
PASSED MID ADOPTED at a regular meeting of the City Council of the City
of Cupertino thie 7~h day of January ~ 1980. by the folloving vote:
