RESOLUTION OF AGREEMENT PURSUPuvT TO REVENUE AND TAXATION
CODE, SECTION 99 FOR E%CHANGE OF PROPERTY T~UC REVENUES
FOR TERRITORIES AFFECTED BY A JURISDICTIONAL CHr1NGE
WEiEREe1S, subparagraph (b) of Section 99 of the Revenue and Taxation
Code requires that the Board of Supervisors negotiate an exchange of property
tax revenues with the city for territory affected by a jurisdictional change;
and
WEIEREAS, the cities and county wish to Eacilitate orderly and expeditious
jurisdictional changes; and
WIiEREAS, the cities and the county have reached agreement pursuant t~ the
above referenced code section;
NOW, THEREFORE, BE IT RESOLVED by the City Councll of the City of Cupertino,
[hat the annexing city shall receive the proportion of the one percent (i%)
property tax revenue previously received by the detaching special districts, but
not less tnaC the proportion of [he property tax received by the city in that
city's tax rate area composed of the same jurisdictions receiving a portion of ttp
one percent (1%) property tax;
BE IT FURTHER RESOLVED tha[ this distribution formula shall be applied to
jurisdictional changes which were effective during fiscal year 1978-79 pursuant
to subparagraph (d) of Section 99 of the Revenue and Taxation Code; and
BE IT FURTHER RESOLVED [hat this distribution formula shall be applied to
all pending and future jurisdic[ional changes; and
BE IT FURTHER RESOLVED that the County :luditor be no[ified of this resolu[ion
pursuant to subparagraph (b) of Sec[ion 99 of the above referenced ~~ode.
