OF THE STREETS AND HIGHtdAYS CODE OF THE STATE OF CAI.IFORYIA, RETAINING PUBLIC UTILITIES EASEZ[ENT AiID RETAINI.IG DEVELOPME:IT RIGHTS WHERE.IS, hearing on Resolution of Intention No.5094 was held on Sepcember 17, 1979, at a regular meeting of the City Council at 10300 Torre Avenue, Cupertino, Calitornia; and WfiEREAS, it appear that notice thereof was duly given as required by law; and '.dHEREAS, from the evidence presented, both oral and documentary, it appears to be to the best interest of the City [o vacate the hereinafter described portion of a City street; and that said portion of said City street is unnecessary for present or prospective public street purposes, but is necessary to be retained as public utilities easemen[ and retained tor development rights. WHER~AS, existing streets are adequace to handle present and future pro- jected traffic; and WHEREAS, vacation is in conformance wi[h the City's General Plan; ~OW, THEREFORE, BE IT RESOLVED: 1. That all or any protests against the vacation of said portion of City street be and hereby are overruled and denied; 2. That said portion of Stevens Creek Boulevard at Ridgeway Drive described in Exhibits "A" and "B" attached hereto and made part hereoE, be and hereby is vacated, but is retained as a public utilities easement and retained Eor developmen[ rights.
