RESOLUTION N0. 5104
A RESOLUTIOH OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
PROVIDING FOR LIEN ASSESSMtiNTS AND FOR TtiE COLLECTION OF
SAME RESULTING FROM TfIE ABATF2tENT OF PUBLIC NUISANCES
WNERGAS, after due no[ice a public hearing [hereon was held at a regular
mee[ing of the City Council on January 2, 1979, at which the City Council
declared that the grow[h of weeds, the accumulation of garbage, refuse,
cut[ings and other cor~bustible trash upon cer[ain proper[ies as described in
City of Cuper[ino Resolu[ion No. 4850 to be a public nuisance; and
WHEREAS, from the evidence presen[ed, both oral and written, [he City
Council acquired jurisdiction over and nba[ed said nuisances; and
W}1EREAS, af[er due no[ice of a repor[ on proposed assessments was sent
by regis[ered let[er [o the affected property owners a[ [he address appearing
on the tax rolls, which le[ter advised tha[ a hearing would be held at the
City Council meeting of September 4, 1979; and
WHEREAS, said hearing was held by the City Council a[ the [ime and place
fixed for the receiving and considering of such repor[ and proposed assessment;
NOW, TNEREFORE, BE IT RESOLVED that [he Ci[y Council does hereby confirm
tha[ the cos[s of abating said nuisances shall be as se[ for[h on Exhibit "A"
attached hereto and made a part hereof und said costs shall constitute a lien
on the affected property. ~
BE IT FURTHER RESOLVED that [he County Fire Marshal shall cause [he amount
of the assessments [o be entered on the County Assessnen[ Roll opposite the ~
description of the particular proper[y, which assessment so entered on [he Coun[y I
rolls shall be collec[ed toge[her with nll other taxes thereon upon the property '
a[ the same time, and in the same manner, as general Ci[y taxes are collec[ed
and shall be subject to the same penali[es and intPres[, and [he same procedure
and sale in the case of deli.nquency as provided for City tnxes.
PASSED AND ADOPTED at a regular mee[ing of the City Council of the City
of Cupertino this 4th day of September , 1979 by the following vote:
