~ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ORDERING VACATION OF A PORTION OF STE~IENS CREEK BOULEVARD
AT SYRNE AVENUE, RETAINING SAID PORTION AS PUBLIC UTILITY
EASEMENT, SANITARY SEWER EASEMENT, PEDESTRIAN A,~ID BIKEWAY
EASEMENT, AS PROVIDED IN SECTION 8320 ET. SEQ. OF THE
STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA
WHEREAS, hearing on Resolution of Intention No. 4994 was held on
the 7th day of May, 1979, at a regular meeting of the City Council a[
10300 Torre Avenue, Cupertino, California; and
WEiEREAS, it appears that notice thereof was duly given as required
by law;
WEIEREAS, from the evidence presented, both oral and documentary, 1t
appears [o be to the best in[erest of the City to vacate the hereinafter
described portion of a City street; and that said portion of said City
street is unnecessary for present or prospective public street purposes,
but is necessary to be retained as public utility easement, sanitary sewer
easement, pedestrian and bikeway easement;
WHEREAS, existing streets are adequate to handle present and future
projected [raffic; and
WFiEREAS, vacation is in conformance with the City's General Plan;
NOW, THEREFORE, BE IT RESOLVED:
1. That all or any protests against the vacation of said portion of
Ci[y street be and hereby are overruled and denied;
2. That said portion of Stevens Creek Boulevard at Byrne Avenue described and
shown in Exhibits "A" and "B" attached hereto and made part hereof,
be and hereby is vacated, but is retained as public utility easement,
sanitary sewer easement, pedestrian and bikeway easement.
BE IT FURTAER RESOLVED:
That [he City Clerk be and hereby is instructed and directed [o cause a
certified copy of this resolution, a[tested to and sealed with the official seal
of the City, to be recorded with the County Recorder of the County of Santa Clara,
California, forthwith.

STEVENS CREEK BOULEVARD AT BYR'VE AVENUE
~ All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, more particularly described as follows:
Beginning at the northeast corner of that certain 1.951 acre parcel of land
as shown upon that certain Tract No. 150, Stevens Creek Subdiviaion Map No. 2,
which map was recorded in Book 5 of Maps at Page 4 and 5, Santa Clara County
Recorda;
Thence S. 89° 49' W. 554 feet more or less, along the southerly line of
Stevens Creek Road as shown on said Tract No. 150 and continuing along the
southerly line of Stevens Creek Road as shown upon that certain Record of
Survey, which map was recorded in Book 98 of Maps at Page 48, Santa Clara
County Records; to a point of intersection with the northerly prolongation
of the westerly line of the parcel of land as shown upon said Record oE Survey;
Thence northerly a distance of 18 feet, more or less, along said westerly line
and ita northerly prolongation to the intersection with the southerly line of
the proposed Stevens Creek Boulevard Plan Line, which Plan Line was recorded
in Book 7 of Plan Line Maps a[ Pages 113-121, Santa Clara County Records;
Thence easterly a distance of 230 feet, more or less, along said proposed
southerly line of Stevens Creek Boulevard to an angle point;
Thence northeasterly, a distance of 320 feet more or less, along said proposed
southerly line of Stevens Creek Boulevard to a point of intersec[ion with the
northerly prolongation of the easterly line of said 1.951 acre parcel of land;
Thence southerly a distance of 35 feet, more or less, to the Point of Beginning.
