A RESOLUTION OF THE CITY COUNCIL OF THE CIT7t UF CUFExTI2I0
INITIATING ANNEXATION PROCEEDINGS PL'RSli~1NT TU SECTION
35031 OF THE GOVERNMENT CODE AND SETTI~G TI2-~ AND PLACE
FOR THE PUBLIC HEARING OF "PERt1AhENTE 78-8"
Wt1EREAS, Chief Petitioner Blanche Barthwick Woelifel petitioned LAFCO
Co initiate proceedings for annexa[ion of certain territor~ with boundaries
as set forth in Exhibit "A"; and
WHIItEAS, LAFCO, by Resolution No. 78-17~, authorized che Ci[y to pro-
ceed as the conducting agency for [he annexation known as "Permanente 78-8";
NOW, TkiEREFORE, BE IT RESOLVED that '
(a) Proceedings are under the Municipal Organization Act of 1977.
(b) Said territory is uninhabited as deterniined by LAFCO.
(c) The reason for this proposal is as follows:
To be[ter ut+_lize services vi[hin the City of Cupertino.
(d) LAFCO has se[ forth no terms or conditions for the annexa[ion in
its findings.
(e) A public hearing be set not Less than 30 days nor more than 45 days
from this date.
(f) Mailings and notices as se[ forth vithin Section 35223 and Sections
56086 and 35222 of the Government Code be accomplished forthwi[h.
(g) Any ovner vithin [erritory of proposed anne:cation may file a writcen
protes[ against the annexation with the City Clerk at any time prior
to the conclusion of the Ci[y's hearing.
BE IT FURTHER RESOLVED:
1. That [he 20[h day of Navember, 1978. a[ 7:30 p.m., in the Council
Chamber, City Hall, 103QQ Torre Avenue, Cuper[ino, California is
the [ime and place fixed for the hearing on the proposed annexation.
2. That the City Clerk shall cause a certified copy of this resolution
Co be published in the manner pzescribed by law, and shall cause
certified copies to be posted along the area affected at least [en
days prior [o hearing, no more tha~ 300 feet aparc and with a mini-
mum of [hree posted. The City Clerk is fur[her authorized to send
a cer[ified copy of this resolution to the Executive Officer of L4FC0.
