' RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CDPERTINO DfAKING EXPRESS FINDING THAT CERTAIN
F10DIFICATIONS OR CHANGES TO THE UNIFORM BUILDING
CODE (1976 EDITION), THE UNIFORM PLUMBZNG CODE
(I976 EDITION) AND THE UNIFORM MECHANICAL CODE
(1976 EDITION) ARE NEEDED
RECITALS:
(a) Section 17985.5 of the Health and Safety Code
(added in 1970) provides, in part:
"In adopting the ordinance or regulations
pursuant to Section 17958 (relating to
regulation adopted by the Commission of ,
Housing and Community Development, pursuant
to Section 17922, establishing uniform housing
code requirements), a city...may make such
changes or modifications in the requirements
contained in regulations adopted puzsuant to
Section 17922 as it determines are reasonably
necessary because of local conditions".
(b) Section 17958.7 (added in 1970) provides, in part:
"The governing body of a city...making any
modifications or changes pursuant to Section
17958.5 shall make an express finding that
such modifications or changes are needed.
Such finding shall be available as a public
record and a copy, together with the modific-
ation or change, filed with the Department (of
Housing and Community Develop,~~ent)..."
NOW, THEREFORE, SE IT RESOLVED by the City Council of
the City of Cupertino, State of California, as follows:
1. The proposed express findings set forth in Exhibit "A"
are hereby adopted; -
2. Upon the basis thereof, it is hereby found that the
modifications or changes to the Uniform Suilding Code (1976
Edition), the Uniform Plumbing Code (1976 Edition) and the

. Uniform Mechanical Code (1976 Edition, as set forth in the
proposed ordinances adaping those codes are needed.
3. The City Clerk is hereby directed to make a
public record of this Resolution, and to file a certified
copy thereof with the California Department of Housing
and Community Development.
PASSED AND ADOPTED by the City Council of the City of
Cupertino, this 5ch _day of Sep~ember, 1978, by the

the following is submitted as ,~ustification for the modifications and changes

Uniform Plumbing Code, as [hey affec[ [he State Housing Law.
The Unifarm IIuildins Code Sec[ions 204, 304(d), 304(e), 1601(a) 2907 Uniform
Plumbing Code Sec[ions 20.3, 20.7, 20.14 and Uniform Mechanical Code Section 203.
Section 204, Soard of Appeals amended: Designates a peraon or body [hat "

Section 304(d). Required Inspections added.
II Section 304(e) authorizes [he Building Official to require addi[ional
' inspection [o those designated in Section 304(d), but requirelnent for underfloor
inspection before covering should be shown in the ordinance for those requesting
' a list of our construction procedures. This inepection is vital [o sound construc-
tion practices and [o assure that al1 of the trenching of underfloor is backfilled,
heat ducts are properly supported and clear of ear[h and that structural members
are adequately nailed and have not been displaced, notches cut or otherwise
changed from the original installa[3on and approval. The above inspection cannot
be properly performed after subfloor is in place, especially with [he quallty oi
cons[ruction today.
Section 304(e), Other Inspec[ions added. Numerous lending ine[itutions are
now requiring verifica[ion for obvious alterations or addi[ions to s[ructures
within our Ci[y before a loan is approved, and other agencies and individuals are
requestine inapections for move-in, illegal s[ruc[ures, etc. The amendment to
this section sets minimum fees for inspec[ions not specifically se[ forth in the
1976 Uniform Suilding Code.

Section 1601 defines fire zones within the Ci[y. This addition declares all
of the City in Fire 7.one 3 by the recommendation of the Cupertino Safety Cownission
and with the adop[ion of the 1973 Uniform Fire Code for which [he findings were
filed with the S[ate by Resolu[ion No. 4408 in March of 1977.
Section 2901(a), Footings General added. This section does not require minimuu~
I amount of steel reinforcing for foundations. Ci[y of Cupertino i~ in an extremely
` hazardous earthquake faul[ areu, and [he requirement for a minimum of two (2) 1/2"
, reinforcing bars is appropriate. Even though geological and soils reports normally
require steel in foundations, we need this insertion in our ordinance to be assured
that structural stability is maintained in all construction in our area.
Also, wiih the permitted use of plastic water service under the plumbing code,
elec[rical grounding relies on the ufer gtound system consisting of reinforcing
steel in the founda[ion footings. With this minimum reinforcing steel requirer.~en[
inserted in [he ordinance, thoae requesting data or preparing estimates for
constructlon wi[hin our City will be aware of this requiremen[.
Section 20.3, Viola[ion and Penalties amended. This is to insert penalties
for non-compliance for violations of the Uniform Plumbing Code, to conform to the
Cupertino Municipal Code.
Sec[ion 20.7, Cost of Permits amended: 1) Cost of sani[ary systems was
amended to read as follows: sewer, sani[ary or s[orm lines for each 200 linea 1
feet or frac[ion thereof shall be $5.00. This charge is jus[ified since $5.00 is
not adequate compensation for the inspec[or's time when the line~exceeds 200 feet,

d) for inspection ou[side of regular ho~ra. We receive many requests for these
typea of inspecti.ons, for which a fee is not designated in the plumbing 'code.

escablistied to compensa[e for the inspection time involved and also to make it
available to the public by ordinance for [hose agencies or individuals who have
to document a cost for their records.
