CC Resolution No. 4720 • s RESOLUTION N0. 4720 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRE$ THE FORMA- TION OF AN UNDERGROUND UTILITY DISTRICT ON THE EAST SIDE OF FOOTHILL BOULEVARD FROM A POINT 125 FT. SOUfH OF SALII~t ' AVENUE TO A POINT 80 FT. NORTH OF SALF?1 AVENUE BE IT RESOLVID BY THE CITY COUNI;lL OF T}iE CITY OF CUPERTINO AS FOLLOWS: WHERFAS, Section 14.20 of the Cupertino Municipal Code establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and W}iEREAS, substantial advantage exisis in the effor[ [o extend the program for removal of overhead utilities alorig Foo[hill Boulevard; and WHEREAS, benefits include the ability to obtain credits toward the overall cos[s under Sta[e Public Utilities Commission regulations; and W}iEREAS, the adoption of said district will provide an equitable means of effecting [he removal of overhead lines on Foothill Boulevard; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the , City Council of the City of Cupertino on June 19, 1978, at the hour of 7:30 p.m. in the Ceuncil Chamber of the City Nall, Cupertino, California, [o ascertain whether the public necessity, heal[h, safety or welfare requires the removal of poles~ overhead wires and associated overhead structures and [he underground installation of wires and facilities for supplying elec[ric, cormnunica[ion, or similar associated service in the DiFtric[ hereinabove described. 2. A[ such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be con[inued from time to time as may be de[ermined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on [he last equalized assessmen[ roll and utili~ies concerned of the time and place of such hearing by mailing a copy of this Resolution to such property ovners and utilities concerned at least ten (10) days prior to the da[e thereof. ~ t ~ ~ Resolution No. 4720 r , 4.
