WHERF.aS, the applicant has met [he burden oE proof required to support
his said application; and
WHEREIS, the Planning Commission, after duly noticed public hearings, has
[orwarded its recommendation to [he City Council;
90W, THEREFORE, BE IT RESOLVED tha[ after careful consideration of maps,
facts, exhibits and o[her evidence submitted in this matter, the application
ior the Variance (S-V-77-Revised) be and the same is hereby approved, subject
to conditions in Planning Commission Resolution No. 1825, attached hereunto as
Fachibit "~1".
BE IT FI;RTHER RESOLVED [hat the ceport of findings a[tached here[o is app-
roved and adopted, and that the City Clerk be and is hereby directed to notify
the parties affected by this decision.

~ istics ia che nature of tne propert~ to be aFfecced, or thac
its location or its surroundings are sucn as will permit the
Coamission co make a determination t4at a liceral enforce-
ment of the Ordinance would result in practical difficulties
or unnecessary hardships; and
That the granting of the application is necessary for the
preservation and eajayment of subscantial property rights;

3. That the heariags show chat [he granting of the application
' will not materially affect adversely the healt4 or safety
of persons residing or working in the neighborhood of the
property which is the subjec[ oE the application, and that
the use of said propertv in the manner in which it is pro-
posed to be used will not be materially decriaental to the

VOW, THEREFORE, BE IT RESOLVED:
That afcer careful consideration of maps, facts, exhibits and
other evidence subaitted in this matter, the application for the
Variance be, and the same is, hereby recommended for approval to
the City Council of the City of Cupertino for appropriate action,
subject to [he coaditions stated on Page 2; and
BE IT FliRTHER RESOLVED:
That the aforementioned findings are approved and adopted, and
that the Seeretary be, and is hereby, directed co notify the
parties affected by this decision.
