CC Resolution No. 4647 ~ ~ RESOLUTION ti0. 4647 A RESOLUTION OF THE CITY COUNCIL OF THC CITY OF CUPERTINO CERTIFYING THE FIVAL EWIRON;tEt7TAL L~SPACT REPORT FOR THE NELLIS RESIDENTIAL PROJECT (REGYART CA.*IY09) AS TO ITS C0:1- PLIANCE WITk THE CALIFORNIA ENVIRON1~fENTAL QUALITY ACT AND STATE A.~D LOCALLY ADOPTED GUIDELI:IF.S WHEREAS, at a public hearing held this date the C1ty Council has reviewed and considered Che contents of the final Environmental Impact Report for the ~ellis Residential Project in Regnart Canyon which involves the prezoning and rezoning of 94 acres in accordance with the General Plan Slope Density Formula, subdivision of said 94 acres into 23 sinRle-famiiV residential lots, and annexation of 35.5 acres of the overall site to the City of Cupertino, and WHF.REAS, upon conclusian of said review, the Council has found the final I Environmental Impact Report to be in complete compliance with the California i Environmental Quality Act and State and locally adopted guidelines for the implementation of said Act. , VOW, TfiEREFORE, BE IT RESOLV~D that the City Council of the Ci[y of 'i Cupertino does hereby certify the final Environmental Impact Report of wMch copy of the approved minutes of this meeting shall become a part thereof and ' further directs the City Clerk to file a Notice of Determination with the Clerk of Santa Clara County setting forth [he following information: a. The project is described as the prezoning, rezoning and subdivision of 94 acres to allow the development of 23 single-family residential lots and the annexation of 35.5 acres of the overall si[e that is currently not within City boundaries. b. The City Council decision is to approve the projec[. c. The project will not have a significant impact on the environment. d. An Environmental Impac[ Report has been prepared for the project. e. A statement of written findinQs descrihing [he incorporation of mitigation measures into the project or specific findings why other considerations make infeasible the mitigation measures has been completed and is included in the final Environmental Impact Report.
