RESOLUTION N0. 4623
a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ORDERING VACATION OF A PORTION OE p1ADERA ROAD, RETAINING
IT AS A SANITARY SEWER EASEMENT ~PID A PUBLIC UTILITY EASE-
MENT, AS PROVIDED IN SEC'fION 8320 ET SEQ. OF THE STREETS
AND HIGHWA'tS CODE OF THE STATE OF CALIFORNIA
WHERE.IS, hearing on Resolution uf Intention No. 4605 was held on November
21, 1977, at a regular meeting of the City Council at 10.300 ToXre Avenue,
Cupertino, California; and

WHEREAS, ic appears that notice [I~ereof was duly given as~required by
law; and
WEiEREAS, from the evidence presented, both oral and documentary, it
appears to be to the best interest of the C1ty to vaca~a the hereinafter
described portion of a City street; and that said portion of said City street
is unnecessary for present or prospective public street purposes, bu[ is nec-
essary to be retained as ~public utility easement and sanitary sewer easements;
and
WHERF.~1S, existing streets are adtquate [o handle present and future pro-
jected traffic; and
WtiEREAS, vaca[ion is in conformance with [he Ci[y's General Plan;
NOW, THEREFORE, BE I'f RESOLVF.D:
1. That all or any procests aFainsc the vacati~n of said por[ion of a
City street be and hereby are overruled and denied;
2. That said portion of Madera Road described and shown in Exhibits
"A" and "B" at[ached hereto and made part hereof, be and hereby are vacated,
but are retained as public utili[y easements and sanitary sewer easemen[s.
BE IT FURTHER RESOLVED:
That the Cicy Clerk be and herehv is inctructed znd directed to cause
a certified copy af this resolution, at[ested to and sealed with the official
seal of the Ci[y, to be recorded wi[h [he County Recorder of the Coun[y of
Santa Clara, Culifornia, forthwith.

All of that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, described as follows:
~ A portion of Madera Road (40 feet wide) as said Road is shown upon that certain
~ map entitled, ":iap of Inspiration Heights Monta Vista", filed for record April
~ 11, 1917, in Volume P of Maps at page 15, San[a Clara Coun[y Records, and being
~ more particularly described as follows:
BEGINNING at an angle in the general Southerly line of said Madera Road at the
:iorthwesterly common corner for Sections 417 and 418, as said Sections are shown
on said map; thence from said point of beginning Southeasterly along the Easterly
line of said Section 417, South 31°50'00" East 9.00 feet; thence South 81°53'25"
, West 51.75 fee[; thence Sou[h 83°35'17" West 100.08 feet; thence South 89°14'46"
I West 110.03 feet; thence North 83°53'14" West 142.39 feec to a point in the
~I Westerly line of Section 414 as shown on said map; [hence along che Westerly
' line of said Section 414, North 3°30'00" West 27.00 feet to a point in the genezal
Sou[herly line of said Madera Road; thence Westerly along the last named Southerly
line, South 77°00' West 141.38 feet; thence Wescerly along an arc of a tangent
' curve to the right with a radius of 15.00 feet through a central angle of 99°50'
an arc distance oE 26.16 feet to a point of tangency in the most Westerly line
of said Road in the Eas[erly line of Section 412, as said last named Section is
shown on said map; thence along the Westerly and Northwesterly lines of said Road
as follows: North 3°10' West 63.47 feet, Northerly along an arc of a tangent
curve [o the righ[ wi[h a radius of 15.00 feet through a central angle of 56°34'
an arc distance of 14.81 feet, tangent to che preceding curve, North 53°24' East
72.93 feet and Yorth 45°OS' East 79.9 feet, more or less, to the intersection
with Che Southvesterly line of that certain parcel of land described in Che Qui[-
claim Deed from Kaiser Cement and Gypsum Corpora[ion, formerly known as Permanen[e
Cement Company, to City of Cupertino recorded October 11, 1968, in Book 8294
of Official Records at page 1, Santa Clara County Records; thence along said
Southwes[erly line, South 33°46'30" East 40.77 feet to the intersection with a
Sou[heasterly line of said Road in the Northwesterly line of Sec[ion 463 as said
last named Section is shown on said map; thence along the Southeasterly lines
of said Road as follows: South 45°OS' West 74.93 feet; South 53°24' West 55.00
fee[, Southwesterly along an arc of a tangent curve to the left with a radius of
8 feet, [hrough a central angle of 156°24' an arc distance of 30.88 feet to
a point of tangency in the general Northerly line of said Madera Road in a
general Southerly line of said Section 463; [hence along [he general Northerly
Lines of said Madera Road as follows: North 77°00' East 140.00 feet, South
80°42' East 109.5 feet and South 87°37' East 166.62 feet; chence continuing along
said general Northerly line and along the Easterly prolonga[ion thereof, North
88°50' East 86.59 feet to an angle in the general Southerly line of said parcel
described in said Quitclaim Deed [o City of Cupertino; thence leaving said Easterly
prolonged line, South 4°03'21" East 20.03 feet, more or less, to the centerline
of Madera Road in the Northwesterly prolongation of the line dividing said Sec-
tions 417 and 418; thence along said Northwesterly prolonged line, South 31°50'
East 23.25 feet [o [he point of beginning of this description.
