CC Resolution No. 4549 ~ ~ RESOLUTION N0. 4549 , A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ORDERING VACATION OF PUBLIC UTILITY EASEMENT AND SANITARY ~ SEWER EASEMENT, RETAINING A PORTION AS STORM DRAIN EASE- MENT, SANITARY SEWER EASEMENT, AND WATERLINE EASEMENT, PURSUANT TO SECTION 50!+30 ET SEQ. OF THE GOVERNNIENT CODE OF THE STATE OF CALIFORNIA, LOTS 22 AND 23 OF TRACT 6015, POINTE DE ANZA, STELLING ROAD AND ALVES DRIVE WHEREAS, hearing on Resolution of Intention No. 4537 was held on August 16, 1977 at a regular meeting of the City Council at 10300 Torre Avenue, Cuper- tino, California; and WHEREAS, it appears that notice thereof was duly given as required by law; and WHEREAS, from the evidence presented, both oral and documentary, it ap- pears to be to the best interests of the City to vacate the hereinafter des- cribed public utility easement and sanitary sewer easement over Lots 22 and 23 of Tract No. 6015, Pointe De Anza, excepting therefrom the southerly 15 ft. strip over and on Lot 23; NOW, THEREFORE, BE IT RESOLVED: l. That all or any protests against the vacation of said public utility easement and sanitary sewer easement be and hereby are overruled and denied. 2. That that certain public utility easement and sanitary sewer ease- ment over Lots 22 and 23 of Tract No. 6015, Pointe De Anza, excepting therefrom the southerly 15 ft. strip over and on Lot 23 more par- ticularly described in description and map attached hereto and made part hereof as Exhibits "A" and "B", be and hereby is vacated. 3. That the southerly 15 ft. strip over and on Lot 23 shall continue to be retained as easement for storm drain, sanitary sewer, and waterline purposes. BE IT FURTHER RESOLVED: That the City Clerk be and hereby is instructed and directed to cause a certified copy of this resolution, attested to and sealed with the official seal of the City to be recorded with the County Recorder of the County of Santa Clara, California, forthwith.
