RESOLUTION N0. 4524
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING QUITCLAIM DEED AND AUTHORIZATION FOR UNDERGROUND
WATER RIGHTS FROM THE ORCHARA VALLEY PARTNERSHIP, A CALIF-
ORNIA LIMITED PARTNERSHIP, BY WESTERN REAL ESTATE DEVELOP-
MENT CORPORATION dba TERRANOMICS DEVELOPMENT CORPORATION,
A CALIFORNIA CORPORATION, GENERAL PARTNER, SOUTHEAST
CORNER OF STEVENS CREEK BLVD. AND PORTAL AVENUE
WHEREAS, The Orchard Valley Partnership, A California Limited Partner-
ship, by Western Real Estate Development Corporation dba Terranomics Develop-
ment Corporation, a California Corporation, General Partner, has executed a
"Quitclaim Deed and Authorization", which is in good and sufficient form,
quitclaiming all its rights in and authorizing the City of Cupertino, County
of Santa Clara, State of California to extract water from the underground '
basin, underlying that certain real property situate in the City of Cupertino,
more particularly described in the attached Exhibit "A" as follows:
All that certain real property situate in the City of
Cupertino, County of Santa Clara, State of California,
as shown and delineated on that certain map filed in the
office of the County Recorder of .the County of Santa Clara
on the 17th day of June, 1966, in Book 211 of Maps at Page
15.
NOW, THEREFORE, BE IT RESOLVED that the City of Cupertino accept said
"Quitclaim Deed and Authorization" so tendered; and
IT IS FURTHER RESOLVED that the City Clerk be and he is hereby authorized
to record said "Quitclaim Deed and Authorizat~c~n" and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this lst day of AuQUSt , 1977, by the following vote:

Exhibit "A"
All that certain real property situate in the City of Cupertino, County of Santa
Clara, State of California, described as follows: `
BEGINNING at the point of intersection of the Southerly line of that certain 15.785
acre parcel of land as shown on that certain Map entitled "Record of Survey Lands of
Paganini", which Map was filed for record in the office of the Recorder of the County
of Santa Clara, State of California on June 17, 1966 in Book 211 of Maps, page 15,
with the Easterly line of that certain parcel of land described in the Dedication
for Roadway Purposes to the City of Cupertino, dated July 20, 1967, recorded August
16, 1967 in Book 7823 of Official Records, page 449; thence from said point of be-
ginning, along said last named line North 0° 09' S8" West 455.23 feet; thence along
the arc of a tangent curve to the right with a radius of 30.00 feet, through a central
angle of 89° 45' S8" for an arc lengtYc of 47.00 feet to a point in the Southerly line
of Stevens Creek Boulevard, as established by Deed to the City of Cupertino, dated
April 15, 1966, recorded April 20, 1966 in Book 7353 of Official Records, page 718;
thence along said last named line North 89° 36' East 902.18 feet to the point of
intersection thereof with the most Easterly line of said 15.785 acre parcel; thence
along the boundary lines thereof the following bearings and distances: South 0° 24'
E~st 358.27 feet; thence South 89° 37' West 144.85 feet; thence South 17° 42' West
133.37 feet to a Southeasterly corner of said 15.785 acre parcel; thence along the
most Southerly line thereof, South 89° 36' West 748.01 feet to the point of beginning.
