RESOLUTION N0. 4475 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING RESOLUTION N0. 4396 REGARDING THE CONFLICT OF INTEREST CODE OF THE CITY OF CUPERTINO FOR OFFICIALS AND DESIGNATED EMPLOYEES RESOLVED, by the City Council of the City of Cupertino, as follows: l. Amendment The Conflict of Interest Code of the City of Cupertino for Officials and Designated Employees adopted by Resolution No. 4396 of the City Council on February 22, 1977, is hereby amended to read as follows: Section 4.00 - Place and Time of Filing. g) Any person holding a designated position with the City of Cupertino who is required to file a statement of financial interest with any other agency, which is within the same territorial jurisdiction, may comply with the provisions of this Code by filing a duplicate copy of the statement with the other agency in lieu of an entirely separate document. However, any person holding a de~ signated position who must comply directly with the disclosure requirements of the Fair Political Practices Commission as provided in Sections 87200-87207 of the Government Code need not comply with the provisions of this Code. h) Any person holding a designated position who leaves that position, shall within thirty (30) days after leaving that position, file a statement of financial interest during the period since the filin~; of his previous financial statement filed under 4.00 (c) (d) ~(e)~or (f).of~this Code. Section 7.00 - Penalties. Any person holding a designated position who violates any of the re- porting or disclosure provisions of this Code is guilty of a misdemeanor punishable as provided in Section 91000 of the Government Code and is also subject to any and all civil penalties as prescribed in Section 91004 and 91013 of the Government Code. The above described penalties are in addition to any other penalties as may be prescribed by law. 2. Effective Date The effective date of the amendments to this Code shall be thirty (30) days after adoption of this resolution by the City Council. 3. Filing of Resolution The Clerk is hereby directed to file a copy of this resolution with his office and to make it available to members of the general public.
