CC Resolution No. 4469 ~ ~ RESOLUTION N0. 4469 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO OF APPLICATION FOR THE REORGANIZATION OF TERRITORY IN ACCORDANCE WITH THE DISTRICT REORGANIZATION ACT OF 1965, VICINITY OF FOOTHILL BOULEVARD AND ROUTE 280 APPLICATION FOR THE REORGANTZATION'OE TERRITORY INVOLVING: Detachment from the City of Los Altos, Annexation to the City of Cupertino, Annexation to Central Fire District, Annexation to the Cupertino Sanitary District, of 23± acres south of Route 280 and north of Foothill Boulevard DESIGNATED AS "REORGANIZATION 77-5" TO THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SANTA CLARA: The City Council of the City of Cupertino does hereby apply for reor- ganization as follows: (a) This proposal is made pursuant to the District Reorganization Act of 1965, commencing with Section 56000, Government Code. (b) The nature of the proposed reorganization and the names of all dis- tricts (and cities) for which any such reorganization is proposed are as follows: l. Detachment: City of Los Altos of Area A 2. Annexation: City of Cupertino of Area A 3. Annexation: Central Fire District of Area A 4. Annexation: Cupertino Sanitary District of Area B (c) The principal act (or acts) of any new districts proposed to be formed or new city proposed to be incorporated is (are): None (d) The territory proposed to be reorganized is uninhabited. A description of the exterior boundaries of the territory (metes and bounds) proposed to be included therein is more particularly described on Exhibit "A" attached hereto and by this reference made a part hereof. (e) The reason for this proposal is as follows: To better align the areas of city services and boundaries. (f) It is desired that the proposed reorganization provide for and be made subject to the following terms and conditions: That LAFCO designate the City of Cupertino as the conducting agency for this reorganization pursuant to Section 56271.1 of the Government Code. (g) Terms and conditions as authorized by Section 56470 of the Government Code be considered by LAFCO as said terms and conditions are presented to LAFCO at the public hearings by the City ot Cupertino. (h) Boundary agreements for the two subject cities be modified as required. (i) It is hereby requested that proceedings be taken for the reoganization hereinabove proposed.
