RESOLUTION NO. 4466
A RESOLUTION OF THE GITY COUNCIL OF THE CITY OF
CUPERTINO APPOINTING ENGINEER AND ATTORNEYS
REGNART ROAD LOCAL IMPROVEMENT DISTRICT 77-14
RESOLVED, by the City Council of the City qf Cupertino,
California, tYiat
WHEREAS, this City Council has determined to undertake
proceedings pursuant to appropriate assessment and assessment bond
acts for the acquisition and const.ruction of public improvements;
6VHEREAS, the public interest and convenience will be served
by appointing and employing engineers and attorneys for the prepa-
ration and conduct of said proceedings;
NOW, THEREFORE, IT IS ORDERED as follows:
1. That Paul E. Nowack and Associates, Znc., 220.State
Street, Los Altos, California, is appointed as Engineer of Work
and employed to do and perform all engineeri.ng work necessary in .
and for said proceedings, including the preparation of the requi-
site plans, specifications,maps and descriptions of easements, ~
estimate of costs, diagram and assessment; and that compensation
therefor is hereby fixed at a reasonable engineering fee for all
of said engineering services, said fee to be approved by this .
Council and assessed as an incidental expense of said proceedings.
2. The Director of Public Works of this City is hereby
directed to examine and approve the engineering documents, and to
provide inspection of the construction of said improvements and
to accept said work when it is satisfactorily completed. The cost~
of said inspection shall be assessed as an incidental expense of
said proceedings.
3. That the law firm of Wilson, Jones, Morton & Lynch,
San Mateo, California, is appointed and employed to do and perform
all legal services required in the conduct of said proceedings,
including the preparation c~f all papers not required to be pre-
pared by the Engineer, examining and approving the engineering
documencs and advising the Engineer in the preparation of his work,
advising all officials of this City on all matters relating there~to
when called upon, and furnishing their legal opinion on the validity
of said proceedings and bonds; and that their compensation for such
services is hereby fixed as follows, to wit: 2~1/20 of the total ~
assessment, to be paid from assessments to be levied and bonds to
be issued, and not otherwise. Said compensation shall be as5essed
as an incidental expense of said proceedings.
4. That said engineering fees and said legal fees shall
be payable solely from the proceeds of assessments levied and/or
bonds sold to represent unpaid assessments in said proceedings.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City of Cupertino this 20th day of June , 1977, by the
