RESOLUTION N0. 4353
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
MAKING ITS ORDER DESCRIBING THE BOUNDARIES DESIGNATED AS
"CASTOR 76-16" TO BE ANNEXED TO THE CITY AND ORDERING AN-
~ NEXATIONS TO THE CITY WITHOUT PUBLIC HEARING AS PROVIDED
. BY LAW; APPROXIMATELY 0.276 ACRES, LOCATED ON THE NORTH
SIDE OF SANTA PAULA AVENUE BETWEEN FOOTHILL BOULEVARD AND
MIRA VISTA ROAD:. ' ~
WHEREAS, pursuant to the provisions of the Annexation of Uninhabited
Territory Act of 1939, proceedings have been initiated by the City Council,
at the request of all the owners of the real property situate in the property
hereinafter described, on its own motion to annex to the City all of that
uninhabited territory situate in the County of Santa Clara, State of California
hereby designated as "Castor 76-16"; and
WHEREAS, the Santa Clara County Local Agency Formation Commission, by
Resolution No. 76-229, adopted the lst day of December, 1976, has authorized
the City of Cupertino to annex the territory described in Exhibit "A" and as
shown on the map in Exhibit "B", designated;-;asi~';•'Castor~~76=16"~,..~_witho:utrno.tice,
hearing or election in accordance with the District Reorganization Act of 1965;
and
WHEREAS, the City Council finds that it is to the best interest of the
City and of the territory proposed to be annexed that the territory be annexed
without public hearing;
NOW, THEREFORE, BE IT RESOLVED that the territory described in Exhibit
"A" and as shown on the map in Exhibit "B", attached hereto and made part hereof,
is hereby annexed to the City of Cupertino.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 18th day of January , 1977, by the following vote:

All that certain real property situate in the County of Santa Clara, State
of California, and being all of Lot 22 and a portion of Lot•• 22-A, as shown
, upon that certain Map entitled, "Map of Las Palmas, Monta Vista", which Map
was filed for record in the office of the Recorder of the County of Santa
Clara, State of California, on April 11, 1917 in Book "P" of Maps, at page
17, said Lots 22 and 22-A being described in deed recorded in Book 150, Official
Records, on page 661, more particularly described as follows:
Beginning at the Southeast corner of Lot 22-A as shown on said Map, said corner
also being the Southwest corner of that certain parcel of land annexed to the
City of Cupertino on November 14, 1973, entitled "Deason 73-7";
Thence leaving said point of beginning N. 89°53' W., 20.00 feet along the
Northerly line of that certain parcel of land annexed to the City of Cuper-
tino on November 27, 1970 entitled, "Santa Paula 70-5", said line also being
the Northerly line of Santa Paula Avenue as shown on said Map, to a point being
5.00 feet East of the Southwest corner of said Lot 22-A as described in said
Map;
Thence N. 0°07' E., 100.12 feet along a line parallel and 5.00 feet East of
the Westerly line of said Lot 22-A to a Point on the Southerly line of Lot 22
a distance of 5.00 feet East of the Northwest corner of said Lot 22-A;
Thence N. 89°53' W., 55.12 feet, to the Southwest corner of said Lot 22;
Thence N. 0°07' E., 100.12 feet, to the Northwest corner of said lot 22;
Thence S. 89°53' E., 100.12 feet, to the Northeast corner of said Lot 22,
said point also being the Northwest corner of that certain parcel of land
annexed to the City of Cupertino on September 26, 1973 entitled, '°De Benedetti
73-6";
Thence S. 0°07' W., 100.12 feet, to the Southeast corner of said Lot 22;
Thence N. 89°53' W., 25.00 feet, to the Northeast corner of said Lot 22-A;
Thence S. 0°07' W., 100.12 feet along the Westerly line of said annexation
"Deason 73-7" to the Point of Beginning;
Containing 0.276 acres, more or less.
