~ RESOLUTION N0. 4235
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING GRANT OF EASEMENT FOR ROADWAY PURPOSES FROM MAY
INVESTMENT COMPANY, A LIMITED PARTNERSHIP, OWNER; AND
FRANCISCAN FINANCIAL CORPORATION, A CALIFORNIA CORPORA-
TION, TRUSTEE; LOCATED ALONG THE NORTHEASTERLY SECTION OF
RAE LANE
WHEREAS, May Investment Company, a Limited Partnership, Owner; and Fran-
ciscan Financial Corporation, a California Corporation, Trustee, have executed
a Grant of Easement for Roadway Purposes which is in good and sufficient form
granting to the City of Cupertino, County of Santa Clara, State of California,
easement over certain real property for roadway purposes, situate in the City
of Cupertino, more particularly described in Exhibit "A" and Exhibit "B",
attached hereto and made a part hereof, which is as follows:
All that certain real property situate in the City of Cupertino,
County of Santa Clara, State of California, consisting of approxi-
mately 0.1011 acre located along the northeasterly section of
Rae Lane.
NOW, THEREFORE, BE IT RESOLVED, that the City of Cupertino accept said
grant so tendered; and
IT IS FURTHER RESOLVED, that the City Clerk be and he is hereby authorized
to record said dedication and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 16th day of Au~ust , 1976, by the following vote:

All that certain real property situate in the City of Cupertino, County of
Santa Clara, State of California, more particularly described as follows:
Commencing at the Northeasterly corner of Lot No. 1 and the Southeasterly
corner of McClellan Road, as said corners are shown on that certain 1~4ap entitled
"Tract No. 5239 Fairway VII, be3:rig,a portion of Section 22 of T.7S, R.2W,
MDM", and said Map being recorded in Book 341 of Maps at pages 28 and 29,
Santa Clara County official records; thence from said point of commencement
South 42° 41' 10" East, 60.54 feet to the TRUE POINT OF BEGINNING of the par-
cel to b~e described; thence from said TRUE POINT OF BEGINNING South 42°
41' 10" East, 201.69 feet, along the right-of=way of Rae Lane; thence North
49° 51' 08" East, 23.02 feet; thence North 42° 41' 10" West, 165.25 feet;
thence on the arc of a tangent curve to the left, with a radius of 42.00 feet,
through a central angle of 63° 06' 12", for an arc distance of 42.26 feet,
to the TRUE POINT OF BEGINNING;
Together with`a 10 foot wide strip of land for a Public Service Easement,
said strip of land being Easterly and Northerly of the Easterly and Northerly
lines of the above described parcel.
