CC Resolution No. 4141 t RESOLUTION N0. 4141 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO ESTABLISHING AN INTERIM REGULATION WITH RESPECT TO THE ISSUANCE OF DEMOLITION PERMITS SO AS TO PRESERVE HISTOR- ICAL LANDMARKS W~iERE41S, certain buildings, sites and places in the City of Cupertino present an irrep].aceable reminder of the City's heritage by uniquely preserving and, reflecting the values and aspirations of the City's founders; and WHEREAS, such buildings, sites and places are important in the social, political, economic and cultural annals of t'he City of Cupertino; and ~ WHEREAS, it .is ;in~. the 'publ~ic~ in;terest to preserve. such buildings_ and sites for posterity~ s fruit£ul appreciation of the City's heritage; and Tr]HEREAS, the P7.anning Department and the Planning Commission are engaged in the study of existing historical landmarks in the City of Cupertino, and of appropriate ordinances, rules and regulations to ensure their preservation; anc~ WHEREAS, the City Council finds that, in order to prevent premature destruction of historical landmarks, it is in the best interest of the public health, safety and general welfare to impose interim regulations on the issuance of demolition permiCs, during the stiudy hereinabove described, so as adequately to comp~.ete said stiudy, analyze the results thereof and put into effect the conclusions of such study. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of / Cuper.Eino, as follows: 1. ThaC the Building Official 3s ordered, upon receipt of all applications requesting a permit to demolish any building or structure within the City of Cupertino, not to issue such permit if, in his opinion, such building or structure deserves preservation as a Cupertino Historical Landmark, by applying the following criteria: (a) The property is the first, last, oniy or most significant historical property of its type in the City; or, (b) The property is associated with an individual or group having a profound influence on the history of the City; or, (c) The property is a prototype of, or an outstanding example of, a period, style, architectural movement, or construction; or, (d) If 3t is one of the more noeable works, or the best surviving work, in a region of a pioneer architect, designer or master builder. . ~ 2. In the event the applicant is dissatisfied with the decision of the Building Official not to 3ssue a demolition permit, the applicant shall be entitled, to appeal euc~ decision in writing,to, and to have a hearing before, the Citq Council, whose decision in the matter shall be final and conclusive upon all persons. 3. This resolution shall rema~n in full force and effect either for a period of one (1) year from the date of its adoption, or until an ordinance preserving historical landmarks within the City of Cupertino is enacted by the City Council, and b~ec:omes effective, whichever event sooner occurs.
