RESOLUTION N0. 4051
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
MAKING APPLICABLE THE PROVISIONS OF THE CALIFORNIA
VEHICLE CODE TO PRIVATE ROADS WITHIN VALLCO FASHION PARK
AND VALLCO VILLAGE
WHEREAS, Vallco Fashion Park situated east and west of Wolfe Road, north
of Stevens Creek Boulevard, and Vallco Village.situated west of Wolfe Road
and south of Homestead Road, as shown on the attached Exhibits "A" and "B",
contain privately owned and maintained roads within the City of Cupertino that
are not generally held open for use of the public for purposes of vehicular travel,
but by reason of their proximity to, or connection with highways, the interests
of any residents residing along such roads and the motoring public will best be
served by application of the provisions of the California Vehicle Code to such
roads; and
WHEREAS, Vallco Park, Ltd., sole owner of Vallco Village Shopping Center
and fee owner arid lessor of the Vallco Fashion Park has requested the appli-
cation of the provisions of the California Vehicle Code to such roads afore-
mentioned;
WHEREAS, a public hearing with respect to such petition was duly and
regularly held by the City Council of the City of Cupertino on the 6th day of
October, 1975, after ten (10) days prior written notice to all owners of such
roads.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cuper-
tino, State of California, pursuant to Section 21107.5 of the California Vehicle
Code, that the provisions of the California Vehicle Code shall apply to the
privately owned and maintained roads hereinabove described, provided appropriate
signs are erected by the property owners at the entrance to such roads, of such
size, shape and color as to be readily legible during daylight hours from a
distance of one hundred feet (100'), to the effect that the road is subject to
the provisions of the California Vehicle Code; and
BE IT FURTHER RESOLVED, that the Director of Public Works of the City of
Cupertino is hereby authorized and directed to supervise the erection of any
such signs by the property owners, as well as any additional signs which may
be required to be erected in the future, all of which signs shall be erected by
the property owners at their sole cost and expense.
BE IT FURTHER RESOLVED, that this resolution may be rescinded and all
signs at the entrances to and upon such roads may be removed by the City Council
of the City of Cupertino, after holding a public hearing after ten (10) days
written notice to the owners of such roads, if the City Council finds and deter-
mines that it is no longer in the interests of any residents residing along such
roads and that the motoring public will not best be served by application of the
provisions of the California Vehicle Code to such roads.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 3rd day of November, 1975, by the following vote:
