CC Resolution No. 4013 RESOLUTION N0. 4013 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING THE RULES ON CONDITIONS OF EMPLOYMENT WHEREAS, the Rules on Conditions of Employment contain provisions for employees holding reserve status in the U. S. to take military leaves of absence, and WHEREAS, modifications in these provisions are necessary in order to conform to the California Military and Veterans Code as specifically interpreted by the Attorney General; NOW, THEREFORE, BE IT RESOLVED that Section 8.5 of the Rules on Conditions of Employment is hereby amended to read: Section 8.5 Military Reserve Leave of Absence Employees other than those holding temporary status, who are enlisted in the Armed Forces Reserve or the National Guard, shall be grat~ted leave for any period of active duty spent in reserve training not to exceed 180 calendar days. Such employees shall, on presentation by them of substantiating evidence, be compensated for the first 30 calendar days of such duty at the base salary they would have earned had they not been required to attend the reserve training.
