CC Resolution No. 3972 , . - RESOLUTION N0. 3972 A RESOLUTION ~F THE CITY COUNCIL OF THE CITY OF CUPERTINO AMENDING AND ADDING VARIOUS POLICI~S FOR THE ~N`,ANAGEMENT COMPENSATION PROGRAM OF TH~ CITY OF CUPERTINO WHEFtEAS, a program of Management compensation has been previously adopted by ehe City Council in order to provide compensation for employees in unrepresented management and conf3dential positions; and WHEREAS, represenCed employees have obtained negotiated 3mprovements in sa].aries and betterment of their terms and conditions of employment whicfi Iiave not ~een extended to unrepresented management and confident3al classes; and WHER~AS, the City Council desires to make commensurate adjustmenCs in the total compensation of management and confidential employees; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Cupertino that the Management CompensaCion Policies, attached hereto as Attachments "A", "B" and "C" and by this reference made part hereof are approved and adop~Ced for inclusion within the management compensation program. No. 3972 City of Cupertino MANAGEMENT COMPENSATION PROGRAM Policy No. 7 HEALTA BENEFTT ~'LANS - EMPLOYER CONTRIBUTION It is the pol~cy of the City of Cupertino to provide group hospital and medlcal insurance under whi~li employees in Management or Confidential positions and their dependents may be covered. The purpose of this program is to promote and preserve the health of employees and their families through comprehensive health plans available only through employer sponsorship. Although the premium cost for the insurance provided remains the ultimate responsibility of the employee in a Management or Confidential position, the City shall contribute an amount of $50.00 per employee per month towards the premium or pay the full cost of the premium if less than this amount. If premium amounts for any employee coyered by this policy are less than.$50.00 per month, the difference between the ~rem~utu amount and $50.00 will be contributed by the City to a deferred compensation account in the employee's name in accordance with policy number 11 of this plan and the regulations of the compensation deferment program of the City. Enrollment in the plan or plans made available ~ pursuant to this policy shall be in accordance with Personnel Rules of the City and the provisions of the contract for such insurance between the City and carrier or carriers. No. 3972 City of Cupertino MANAGEMENT COMPENSATION PROGRAM Policy No. 8 FLEXIBLE HOLIDAY3 Tt is the policy of the City of Cupertino to recognize days of histnrical and national significance as holidays of the City without loss of pay or benefits. Recognizing the desireable continuance of municipal services by management and confidential employees resulting from scheduling of occasional holidays at variable times througliout the year, it is the policy of the City of Cupertino to provide days off in lieu of holidays for management and confidential employees at sucfi times as are convenient for each employee and supervisor, when such policy is compatible with the workload and schedule of the City. Employees occupying management and confidential positions shall be provided one day per calendar year as a non-work day with full pay and benefits in addition to those holidays set forth in section 8.1 of the Rules on Conditions of Employment. Section 8.1 of these rules is ~urtfiermore expressly modified by this policy to permit each management and confidential employee to observe a day off in lieu of Lincoln's Birthday at such times throughout the year as may be mutually agreed to between employee and supervisor. For payroll purposes, each sucfi in-lieu-of day off shall be recorded as a holiday. Adopted by Action of The City Council July 7, 1975 ' Attachment "C" Res. No. 3972 City~of Cupertino MANAGEMENT COMPENSATION PROGRAM ~olicy No. 11 DEFERRED COMPENSATTON Tt is the policy~ of the City of Cupertino to provide equitable current compensation and reasonable retixezuent security for management and con~idential employees for services perfox'med ~or the City. The City paxticipates in State and Federal retirement sy~stems and def erred compens~ation plans have been established. Both tfie employee and employ~er~may make contributions from current earnings to tfiese plans. Tlie purpose o£ this policy is to promote means by whicTi. compensation may~ lie pxovided in sucii manner and form to best meet the requ~rements of tlie City~ and the needs of individual employees, thexeby~ increasing tlie aBility~ to attract and retain competent management and confidential employees, The City shall maintain and adzuini,ster means by which employees in manage- ment and confidential posit~ons ~ay defer porfions o~ their current earnings for future utilization. Usage o~ suctL plans shall be sub~ect to such agreements, rules and procedures as are necessary to properly administer eacfi plan. Employee contriButions to such plansznay be made in such amounts as felt proper and necessary by the employee. Employer contributions shall be made pursuant to Management Compensation Plan policies numbers 7 or 10, or in such other form as determined desireable and proper by the City Council.
