A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
AMENDING THE RULES ON CONDITIONS OF EMPLOYMENT PURSUANT
TO THE PERSONNEL COD~
WHEREAS, Memoranda of Understanding between the City and various
employee units have~been approved by the City Council requiring changes 3n
Che Rules on Conditions of ~mployment; and
WH~REAS, the City Council 3.s desirous of maintaining parity
of working conditions between both represented and unrepresented
employees in certain instances, making universal ad~ustments to
cond3Cions of employment ~esirable;
NOW, THEREFORE B~ IT R.~SOLVED by the City Council of the City o£
Cupertino that the Rules on Conditions of ~nployment of the City of
Cupertino are hereby amended to read:
Section 8.34
The City shall pay an_employe~ ~or unused tialances of personal
leave upon retirement, or termination for other than just cause, according
to the following schedules:
1. Upon retirement, w~ich shall require the formal filing o£ the
appropriate forms witih tihe Public Employees' RetiremenC System,
a cash payment equivaLent to fifty percent (.50%) of ~he dollar
va].ue of the unused personal leave balance exceeding sixty days.
The dollar value for such payment shall be calculated at a wage
rate which is the average of ehe preceding five (5) years for the
employee.
2. Upon termination for other than discharge with ,just cause, a
cash payment equivalent to thirty percent (30%) of the dollar value
of the unused personal leave balance exceeding sixty days. The
dollar val.ue for such payment sha7.1, be calculated at a wage
ra~e which is the average of the preceding five (5) years for the
employee.
BE i'T FURTHER RESOLVEb that the following section be approved and
added Co the Rules on Conditions of Employment.

buring the fifteenth calendar year of employment and thereafter an
employee sha11 earn ~racation credits at the rate of one and two-thirds
(1 2/3) work day for each month of completed continuous service.
