RESOLUTION N0. 3935 ~ ~ ~ A F.I:SOLUTION OF T111; CITY COIT;~CIL OF TfIE CITY Or CUPI:RTINO ' APPLYIhG TO THC I'CDL'Rt1L GOVi:P.1`;i•IT:NT FOR It•fPL£PI1:I~TAT70IJ OF ' ~ THE NATIONAL FLOOD INSURANCI: ACT OF 1968~ ~ ~ ~ ~ WfiER~AS, certain areas of City of Cupertino are s~ibject to periodic ~ flooding from streams, having the possibility•of causing serious damages to ~ properties within these areas; and WHEREAS, relief is available in the form of Federally subsidized ilood insurance as authorized by the National Flood Insurance Act of '1968; and ~ ~ k~iEREAS, it is the intent of this Council to require 'the recognition , and evaluation of flood hazards in all official actions relating to land use in the flood plain areas having special flood hazards; and . WEiEREAS, this body has the legal authority to adopt land use and control ~ measures to reduce future flood losses pursuant to Chapter 3, Article S, Sec- tions 65300 et seq. and Chapter 4, Article l, Sections 65800 et seq. of the ~ Government Code of the State of California. NOW, THEREFORE, BE IT RESOLVED, t~iat this City Council hereby: ~ 1. Assures the Federal Insurance Administration that it will enact as ~necessary, and maintain in force for those areas having flood hazards, adequate ~ ' land use and control measures ~ith effective enforcem~nt provisions consistpnt with the Criteria set forth in Section 1910 of the National Flood Insurarece ~ Program Regulations; and ~ ' ~ . 2. Vests the Planning Director and Public ~dorks Director with the ~ responsibility, authority, and neans to:~ ' , . . ~.(a) Delineate or assist the Administrator, at his request, in delineating the limits of the areas having special flood hazards on available local maps;of sufficient scale to identify the location of building sites. (b) Provide such information as the Ad.ministrator may request ~ concerning present uses and occupancy of the flood plain. . ~ (c) Cooperatc ~~ith Federal, State and local agencies and private firms which undertake to study, survey, map, and identify flood plain areas, ~ . and cooperate caith neigt~boring communities with respect to manaoe?nent of . adjoining flood plain areas in order to prevent aggravation of existing ~ hazards. . (d) Submit on the anniversary~date of the community's initial eligibility an annual report to the Administrator on the progress made . during the past year ~~itliiii the community in the development and implemcntation ' of flood plain mar.agemeut measures. 3.~ Appoints t}ie~Public Works Di.rector to maintain for puUlic inspection and Co furnisli upon requcst- a record oL elcvations (in rclation to mcan sea . ~ +1_ • , I . . - ' . .
