CC Resolution No. 3862 A ~ RESOLUTION N0. 3862 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO DECLARING ITS TNTENTION TO ORDER VACATION OF A PORTION OF A PUBLIC UTILITIES EASEMENT WITHTN THE CTTY OF CUPERTINO PURSUANT TO SECTION 50430 ET SEQ. OF THE GOVERNMENT CODE OF THE STATE OF CALIFORNIA, FIXING TTME AND PLACE FOR HEARING AND PROVIDING FOR NOTICE THEREOF; VALLCO FASHION PARK, NORTHERLY OF STEVENS CREEK BLVD. WESTERLY OF WOLFE ROAD WHEREAS, that certain ten (10) fooC pulilic utilities easement within Val].co Fashion ~ark, northerly of Stevens Creek Boulevard westerly of Wolfe Road, more particularly described in description and map attached hereto and made part hereof as Exhibits "A" and '.'B", is deemed unnecessary for present or prospective use; and WHEREAS, the City Council e].ects to proceed pursuant to Section 50430 et seq. of the Government Code of Che State of California; and WHEREAS, it is in the public interest that the City Gouncil initiates the vacation of said easement; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby declares its intention to vacate the aforesaid public utilities easement; BE IT FURTHER RESOLVED: 1. That the 7th day of April, 1975, at 7:30 p.m. in the Council Chamber, City Hall, 10300 Torre Avenue, Cupertino, California, is the time and place fixed for hearing on the above proposed vacation; 2. That the aforesaid date 3s not less than fifteen (15) days from passage of this resolut3on as required by law; 3. That the City Clerk sha11 cause a cert,ified copy of this resolution to be published in the Cupertino Courier, the official newspaper of the City, for at least two (2) successive weeks prior to the hearing, and shall cause certified copies to be posted along the line of the easement proposed to be vacated at least ten (10) days before the date of the hearing and no more than 300 feet apart w~Lth a minimum of three (3) being posted. PASSED AND ADOPTED at a regular meeting of the City Council of the City of Cupert3no on the 3rd day of March , 1975 by the following vote: . No. 3862 All that certain property situate in the City of Cupertino, County of Santa Clara, State of California, described as follows: A 10.00 foot wide strip of land the northerly line of which is a portion of the northerly line of Parcel 2-13 as shown on that certain Easement Deed recordecl in Book 7582 of Official Records at Page 613, Santa Clara County Records, and more particularly described as follows: Commencing at the intersection of the centerline of Amherst Drive with the centerline of Norwich Avenue as shown on that certain Tract Map recorded in Book 112 of Maps at Pages 40 and 41 in the Offi.ce of the County Recorder of Santa Clara County; thence N. 89° 17' E., 131.75 feet; thence S. 0° 05' E., 27.27 feet; thence N. 89° 12' 45" E., a distance of 10.00 feet to the TRUE POINT OF BEGINNING: thence from said TRUE POINT OF BEGINNING along said northerly line N. 89° 12' 45" E., a distance of 525.68 feet to the terminus of said 10.00 foot wide strip of land, said terminus point being 10.00 feet westerly of the westerly right-of-way line of Wolfe Road 108.00 feet in width.
