CC Resolution No. 3851 I RESOLUTZON N0~ 3851 A RESOLUTZON OF THE CITY COUNCIL OF THE CITY~ OF CUP~RTTNO ~ CALLING A PUBLTC HEARING TO DETERMTNE WHETHER PUBLIC NEC- ESSITY, HEALTH, SAFETY, OR WEL~'ARE REQUTRES THE FORMATTON OF AN UNDERGROUND UTILITY DISTRICT ON SARATOGA-SUNNYVALE ROAD FROM PACIFICA DRTVE TO A POINT 500 FEET NORTH OF BOLLINGER ROAD AND ON MC CLELLAN ROAD FROM SARATOGA-SUN- NYVALE ROAD TO A POINT 150 ~EET EAST OF ,~OHN WAY BE IT RESOLVED by the City Council of the City of Cupertino as follows: ~dHEREAS, Municipal Code Section 14.20 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the tiolding of a public hearing to ascertain whether pub~ lic necessity, health, safety~, or welfare requires the removal of poles, over- head wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, Saratoga-Sunnyvale Road and McClellan Road are extens~.vely used by the general public and carry a heavy volume of veTiicular traffic; and WHEREAS, undergrounding will eliminate a heavy concentration of overhead distribution facilities; and WHEREAS, removal of these lines is consistent with tfie City's Policy of undergrounding; NOW;,THEREFORE, BE IT RESOLVED as follows: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the City Council of the City of Cupertino on March 17, 1975, at the hour of 7:30 p. m. in the Council Chamber of the City Hall, Cupertino, Cal- ifornia, to ascertain whether the public necessity, health, safety or welfare requires the removal of poles, overhead wires and asso- ciated overhead structures and the underground installation of wires and facilities for supplyir~g electric communication, or similar asso- ciated service in the district hereinabove described. 2, At such hearing all persons interested shall be given an opportunity to be heard. Said hearing may be continued .from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equaliaed assessment roll and utilities concerned of the time and place of such hearing by maili;ng a copy~ of tfiis resolut~on to suclz property o~aners and util~:ties concerned at least ten (10) days prior to ttie date tliereof . 3�s( 4. The area proposed to be included in the district is shown upon that cer— tain map entitled PROPOSED BOUNDARY UNDE1.GROUND UTILITY DISTRICT, dated February 13, 1975, which. is on file in the office of the City Clerk of the City of Cupertino.
