CC Resolution No. 3822 ~ RESOLUTION N0. 3822 A RESOLUTION OF THE CITY COUNCIL OF TIIE CITY OF CUPERTINO ACCEPTING QUITCLAIM DEED AND AUTHORIZATION FOR UNDER- GROUND WATER RIGHTS FROM JOHN W. HANAHOE; LOCATED ON STEVENS CREEK BOULEVARD WESTERLY OF CARMEN ROAD WHEREAS, John W. Hanahoe has executed a"Quitclaim Deed and Authorization", which is in good and sufficient form, quitclaiming all his rights in and author- izing the City of Cupertino, County of Santa Clara, State of California, to extract water from the underground basin, underlying that certain real property situate in the City of Cupertino, more particularly described in the attached Exhibit "C" and Exhibit "G=1", as follows: All that certain real property situate in the City of Cupertino, County of Santa Clara, State of California, more particularly described in the attached Exhibits "C" and "C-1". NOW, TH~REFORE, BE IT RESOLVED that the City of Cupertino accept said "Quitclaim Deed and Authorization" :s:o tendered; and IT IS FURTHER RESOLVED that the City Clerk be and he is hereby authorized to record said "Quitclaim Deed and Authorization" and this Resolution. No. 3822 That certain real property situate partly within and partly without the City of Cupertino, County of Santa Clara, State of California, described as follows: PARCEL 1: PORTION OF SECTIONS 12 and 28, shown upon that certain Map entitled, "Map of Inspiration Point Monta Vista", which Map was filed for record in the office of the Recorder of the County of Santa Clara, State of California, on April 11, 1917, in Book P of Maps, at page 18, and more particularly described as follows: BEGINNING at a point on the Northerly line of Sylvan Way at the Southwesterly corner of Section 28, as said Way and Section are shown upon the Map above re- ferred to; running thence Northerly along the Westerly line of Sections 28 and 12 of said Subdivision, for a distance of 200.24 feet to the Northwesterly corner of said Section 12; running thence Easterly along the Northerly line of said Section 12 for a distance of 75.12 feet; running thence Southerly and para- lell with the said Westerly line of Sections 12 and 28 for a distance of 200.24 feet to a point on the said Northerly line of Sylvan Way; running thence L~esterly along said,last named line 75.12 feet to the point of beginning. EXCEPTING FROM Parcel 1 so much thereof as lies within the bounds of Stevens Creek Road, as said Road was established by Deed from Joseph Bargette, et al, to County of Santa Clara, dated June 30, 1947 and recorded November 20, 1947 in Book 1446 Official Records page 598. PARCEL 2: All that portion of Sylvan Way, as shown upon that certain Map entitled, "Map of Inspiration Point Monta Vista", which Map was filed for record in the office of the Recorder of the County of Santa Clara, State of California, on April 11, 1917, in Book P of Maps, at page 18, and more particularly described as follows: BEGINNING at a point on the Northerly line of Sylvan Way at the Southwesterly corner of Section 28, as said Way and Section..are.shown upon the Map above referred to; running thence Southerly along the prolongation Southerly of the Westerly line of said Section 28 for a distance of 7 feet, more or less, to a point on the Northwesterly line of Stevens Creek Road, as said Road was established by Deed from Joseph Bargette, et al, to County of Santa Clara, dated June 30, 1947 and recorded November 20, 1947 in Book 1446 Official Records page 598; running thence Northeasterly along the said Northwesterly line of Stevens Creek Road 52 feet, more or less, to the intersection thereof ~aith the said Northerly line of Sylvan Way; running thence Westerly along the said Northerly line of Sylvan Way 50 feet, more or less, to the point of beginning.
