A RESOLUTION OF THE CITY COUNCIL QF THE CITX OF CUPERTINO
AUTHORIZING EXECUTION OF AGREIIKENT BETWEEN THE CITY OF
CUPERTINO AND DEVELOPER, WARREN J. DUNN AND ELVIRA L.
DUNN; RELEASING DEVELOPER FROM TERMS AND CONDITIONS SET
FORTH IN AGREEMENT DATED OCTOBER 17, 1973; CORDOVA ROAD
WHEREAS, the City of Cupertino and Warren J, Dunn and Elvira L. Dunn,
hereinafter designated as "Developer", have entered into a certain agreement,
dated October 17, 1973, which said agreement is recorded as document number
4684390 on January 11, 1974 in Book 0722, pages 540 tfirough 554, inclusive; and
WHEREAS, Developer now is desirous of being released from the terms and
conditions set forth in said agreement, dated October 17, 1973; and
WHEREAS, the City is willing to release Developer from the terms and
conditions set forth in said agreement and it is hereby mutually agreed by and
between the parties to the provisions as set forth in a new agreement of re-
lease approved by the Director of Public Works and the City Attorney;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and the City Clerk are hereby
authorized to execute the agreement releasing the Developer of the terms and
conditions of agreement entered into dated October 17; 1973, and the City C1erk
is authorized to file said agreement of release with the Santa Clara County
Recorder.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino on the 7th day of October , 1974, by the following vote•
