A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
PROV2DING FOR LIEN ASS~SS~4ENTS AND FOR THE COLLECTION OF
SAI~1E REStiLTING FROP4 THE ABATEMENT OF PUBLIC NUISt1NCES
WHEF.EAS, after due notice a public hearing thereon was held at
a regular meeting of the City Council on June 3, 1974 at which the
City Council declared that the growth of weeds, the accumulation of
garbage, refuse, cuttings and other coriliustible trash upon certain
properties as described in City of Cupertino Minute Order to be a
public nuisance; and
GIIiER~AS, from the evidence presented, botli oral and ~aritten, tYie
City Council acquired jurisdict3on over and abate said nuisances; and
ti,13'EP.EAS, after due notice of a report on proposed assessments
~•~as sent by registered letter to the aff ected property owners at the
address appearing on tlle tax roles, which letter advised that a hearing
would be held at the City Council meeting of August 19, 1974; and
WI~IER~AS, said hesring was held by the City Council at tYie time. and
place f ixed for the receiving and considering of such report and
proposed assessment;
NOW, THEREFORE, BE IT RESOLVED that the City Council does
hereby confirm that the costs of abating said nusiances shall be as
set forth on Exhibit "A" attached hereto and made a part hereof and
said costs shall constitute a lien on the affected property.
BE IT FUPTHEP. RESOLVED that the City Clerk shall cause the amount
of the assessments to be entered on the County Assessment Roll opposite
the description of the particular property, whicli assessment so entered
on the County rolls shall be collected together,~~~ith all ott?er taxes
thereon upon the property at the same time, and in the same manner,
as general City taxes are collected and shall be subject to the same
penalties and interest, and the same procedure and sale in the case of
delinquency as provided for City taxes.
