A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ACCEPTING A GRANT OF EASEMENT FROM CHARLES J. BROOKS, RO-
MONA J. BROOKS, GEORGE H. FISH, BERNARD H. HYMEL, MARIAN
S. HYMEL, FRANK J. ZARKA, LOUISE H. ZARKA, WESLF:Y E.
OLSON, RITA RAE OLSON, HAROLD A. SANTOS, MARILEE R. SAN-
TOS, NOORUDIN A. BILLAWALA, CHRISTA H. BILLAWALA, THOMAS
Y. LOCKE AND MAE'LOCKE; LOCATED SOUTHEAST CORNER OF SARA-
TOGA-SUNNYVALE ROAD AND PACIFICA DRIVE
WHEREAS Charles J. Brooks, Romona J. Brooks, George H. Fish, Bernard H.
Hymel, riarian S. Hymel, Frank J. Zarka, Louise H. Zarka, Wesley E. Olson, Rita
Rae Olson, Harold A. Santaos, Marilee R. Santos, Noorudin A. Bi].lawala, Christa
H. Billawala, Thomas Y. Lock and Mae Lock, Grantor, have executed a Grant of
Easement which is in good and sufficient form, conveying to the City of Cupertino,
Grantee, an easement for storm drain purposes over the property situate in the
City of Cupertino, County of Santa Clara, State of California, more particu-
larly described in Exhibit "A" and Exhibit "B", attached hereto and made a
part hereof:
All that certain real property situate in the City of Cuper-
tino, County of Santa Clara, State of California, consisting
of approximately 0.112 acre, located at the southeast corner
of Saratoga-Sunnyvale Road and Pacifica Drive.
NOW, THEREFORE, BE IT RESOLVED that the City of Cupertino accept said
Grant so tendered; and
IT IS FURTHER RESOLVED that the City Clerk be and he is hereby authorized
to record said Grant of Easement and this Resolution.
PASSED AND ADOPTED at a regular meeting of the City Council. of the City
of Cupertino on this 6th day of AuQust , 1974, by the following vote:

All that certain real property situate iri the City of Cupertino, County of
Santa Clara, State of California, described as follows~: .
A non-exclusive easement for the installation and maintenance of storm sewers
and appurtenances thereto upon, over and under that certain strj.p of land 10.00
feet in width',~,the Easterly and Southerly lines of which are more particularly
described as follows:
Beginning on the Westerly line of that certain parcel of land conveyed by Caldelt
~ Investment Company to Pacifica, a partnership, by deed recorded November 24,
. 1964, in Book 6752, Official Records,. at page 385, Santa Clara C;ounty Records,
distant thereon, North 0° 53' 20" East 150.00 feet from the Sourhwesterly
corner thereof, said corner being on the Northerly line of Pacif:ica Drive
(68 feet wide); thence from said point of beginning along said Westerly line,
North 0° 53' 20" East 69.99 feet to the Northwesterly corner thereof; thence
along the Northerly line of said parcel, Sou"th 89° 00' 00" East 198.01 feet
to the Northeasterly corner thereof, said corner being on the Easterly line of
that certain 4.126 acre parcel as shown upon the Record of Surv~y for Edenvale
Land Company, the map of which was filed for record November 23, 1959, in Book
114 of~Maps at page 2, Santa Clara County Records; thence along said last des-
cribed Easterly line, North 0° 53' 20" East 219.99 feet to the Northeasterly
corner of said 4.126 acre parcel and the terminus of this easement.
Containing 0.112 acre more or less.
