~ ~ RESOLUTION N0. 3669
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
GRANTING A VARIANCE TO JOSEPH P. FRANCO (J. D. VANDER-
LAAN) TO REDUCE THE NUMBER OF PARKING SPACES REQUIRED IN
A GENERAL COMMERCIAL ZONE. SAID PROPERTY CONTAINS 5.5
ACRES AND IS WITHIN A CG (GENERAL COMMERCIAL) ZONE LOCA-
TED SOUTHERLY AND ADJACENT TO HOMESTEAD ROAD WEST OF
SARATOGA-SUNNYVALE ROAD
WHEREAS, the applicant has met the burden of proof required to support
his said application; and
WHEREAS, the Planning Commission, after duly noticed public hearings, has
forwarded its recommendation to the City Council;
NOW, THEREFORE, BE IT RESOLVED that after careful consideration of maps,
facts, exhibits and other evidence submitted in this matter, the application
for the Variance (3-V-74) be and the same is hereby approved, subject to con-
ditions in Planning Commission Resolution No. 1265, attached hereunto as Ex-
hibit "A".
BE IT FURTHER RESOLVED that the report of findings attached hereto is ap-
proved and adopted, and that the City Clerk be and is hereby directed to notify
the parties affected by this decision.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 20th day of MaX , 1974, by the following vote:

FURTI~iER FINDINGS :
That the granting of the variance does not constitute a grant of special
privileges inconsistent with the limitations upon other properties in
the vicinity and zone in which the property is situated.
CONDITIONS: ~
1-14. Standard Conditions to the e~tent that they do not conflict with the
. special conditions enumerated herein. In the event a conflict does
existy the special conditions as enumerated herein shall apply.
15. The approval is based upon the site plan labeled Exhibit A, 3-V-74,
as may be amended by additional conditions herein.
16. That the Architectural and Site Approval Committee shall revie~o the
peripheral and internal landscaping areas to determine landscaping
~ adequacy. The Architectural and Site Approval Committee shall have
' the auttiori.ty ~_o remove an additional twenty spaces resulting in a
minimum of 878 off-street parking stalls for the complete ~iomestead
Square Shopping Center.
17. That the 52 f.t. public street on the westerly boundary be installed
prior to issuance of an occupancy permit for the bowling alley or at
~ such time as may be directed by the Director of Public kTOrks.
~ 1S. That the scope of the bowling alley facilities shall be limited to
the uses as stated in the letter,from J. D. Vanderlaan dated April
10, 1974. Specifically that there will be only 40 bowling lanes,
a stand-up snack bar and a 56--seat cocktail lounge.
