A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
A ORDERING VACATION OF A PORTION OF A WIRE CLEARA14CE EASEMENT
WITHIN THE CITY OF CUPERTINO PURSUANT TO SECTION 50430 ET
SEQ. OF THE GOVERiRfETNT CODE OF THE STATE OF CALIFOR3.dIA;
LOCATED AT 10260 PHAR LAP DRIVE, LOT 9, TRACT 3442
1,FHEREAS, hearing on Resolution of Intention No. 3374 was held on.
January 2, 1973, at a regular meeting of the City Council at 10300 Torre
Avenue, Cupertino, California; and
WHEREAS, it appears, that notice thereof was duly given as required
by law; and
WHEREAS, from the evidence presented, both oral and documentary, it
appears to be to the best interests of the City to vacate the hereinafter
described portion of a wire clearance easement; that said portion of said
wire clearance easement is nnecessary for present or prospective use;
NOW, THEREFORE, BE IT RESOLVED:
1. That all or any protests against the vacation of said
portion of a public utilities easement be and "hereby are
overruled and denied;
2. That that certain portion of a public utilities easement,
locate6L at 10260 Phar_ Lap Drive, Lot 9, Tract 3442, described
and shorn in Exhibits "A" and "B" attached hereto and made
part hereof, be and hereby is vacated.
BE IT FURTHER RESOLVED that the City Clerk be and hereby is instructed
and directed to cause a certified copy of this resolution, attested to an`
sealed with the official seal of the City, to be recorded with the County
Recorder of the County of Santa Clara, California, forthwith. v
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 2nd day of _January 1973, by the following vote:
AYES: Councilmen - Irwin, Jackson, Meyers, Sparks, Frolich
NOES: Councilmen - None

All that certain real property situate in the City of Cupertino, County
of Santa Clara, State of California, more particularly described as fol-
lowsa
A portion of Lot 9, as shown on that certain Tract Map
entitled "Tract No. 3442, Oakdell Ranch", filed for
record in Book 165 of Maps at pages 30 and 31, Santa
Clara County Records, being a strip of land 1.0 foot in
width and 14.0 feet in length, the Southerly line of
which is described as follows:
COMMENCING at a point being the intersection of the
Southerly line of that certain W.C.E, and the Easterly
right-of-way line of Phar Lap Drive, as said intersection
is shown on said lot of said Tract 3442; thence S. 82° 37' 18"
E. 93.0 feet along the Southerly line of said W.C.E. to
the True Point of Beginning, thence continuing along said
Southerly line of said W.C.E. S. 82° 37' 18" E. 14 feet to
the terminus of said strip of land, containing .0003 acre,
more or less.
