RESOLUTION N0. 3338
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING
THE GRANTING OF (A) FEE TITLE FOR THE STEVENS CREEK RIGHT-OF-WAY AND
(B) EASIIKEN'I' FOR FLOOD PLAIN PURPOSES TO THE SANTA CLARA FLOOD CONTROL
AND WATER DISTRICT; LOCATID ON THE HORSE RANCH PROPERTY ON McCLELLAN
ROAD NORTH OF RAE LANE
WHEREAS, the City of Cupertino has approved the acceptance of grant of
deed for certain real property from John H. Langman and Jane E. Langman for
paxk purposes; and
WHEREAS, the Santa Clara County Flood Control and Water District has
agreed to contribute toward the acquisition of portions of said property;
and
WHEREAS, the City has agreed to dedicate fee title to the Santa Clara
County Flood Control and Water District for that portion of the Stevens Creek
right-of-way traversing the property which is required for standard channel
dedications; and
WHEREAS, the Flood Control District has agreed to contribute in consid-
eration for the right of a flood control easement over a portion of the re-
maining property; arid
Wf~REAS, the Flood Control District has agreed to allow the City to
utilize for park purposes that portion of the property acquired by the Flood
Control District for .flood control easement;
NOW, THEREF'ORE, BE IT RESOLVID that the City of Cupertino does hereby
authorize the granting of fee title for (a) the Stevens Creek right-of-way,
more particularly described on Exhibit "A-1" and Exhibit "A-2", attached
hereto and made a part hereof which is as follows:
All that certain real property situated in the City of
Cupertino, County of Santa Clara, State of California,
consisting of approximately 2.35 acres located within a
strip of land approximately representing 60 foot half
channel width traversing the westerly and northerly
boundaries of the property ad~acent to Stevens Creek;
and
(b) an easement for flood plain purposes to the Santa Clara County Flood
Control and Water District for property more particularly described in
Exhibit "B-1" and Exhibit "B-2", attached hereto and made a part hereof
which is as follows:

All that certain_ real property situated in the City of
Cupertino, County of Santa Clara, State of_California,
consisting of approximately 5.13 acres located adjacent
to the natural channel of Stevens Creek along its easterly
boundary including that portion of the property for which'
the Flood Control District has designed as a flood plain.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they
are hereby authorized to execute a Grant of Deed, a Grant of Easement
and this Resolution in accordance with the foregoing.
PASSED AND ADOPTED at a regular meeting of the City Council of the
City o.f Cupertino on the 5±j day of September 1972,-by the
following vote:
AYES: Councilmen - Irwin, Jackson, Meyers, Sparks, Frolich
NOES: Councilmen - None
ABSENT: Councilmen - None

Al1 of said lands lying within a strip of land 60 feet in width,

Creek as said strip is shown "Exhibit B" attached hereto and made
a part hereof .
Containing 2.35 acres of land more or less.
