CC Resolution No. 3289 / ~ RESOLUTION N0. 3289 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO AUTHORIZING THE FILING OF A REQUEST FOR EXCEPTION TO T.HE GENERAL WAGE AND SALARY STANDARDS OF THE PAY BOARD WHEREAS, the City of Cupertino is subject to the provisions of the Economic Stabilization Act of 1970 requiring compliance with the policies governing pay adjustments as adopted by the Pay Board on November 8, 1971; and WHEREAS, the said policies of the Pay Board require prior approval for exceptions to the payment of salaries in excess of the general wage and salary standards which exceptions shall be based on such factors as the equitable position of the employees involved and the prevention of gross inequities; and WHEREAS, it has been demonstrated through impartial salary comparison surveys that the City of Cupertino consistently has been among the lowest paid municipality within its labor market are~ which situation has been to its detriment in the recruitment and retention of the best persons available for its work force; and WHEREAS, the City of Cupertino had embarked on a salary increase program of achieving equitability of salaries over a multi-year period, which program has been delayed by the said policies governing pay adjustments; and LJHEREAS, the continued imposition of such restrictions only augments the existing imbalance of salary equitability: NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Cupertino as follows: Section 1. That the City Manager is hereby directed to take im- mediate action to request prior approval of the Pay Board to authorize the granting of pay adjustments in excess of the general wage and salary standards of the Pay Board; Section 2. That an exception to said general wage and salary standards be requested to reflect the individual reassignment to a designated pay grade within the Schedule of Pay Grades of those classes of positions where there is inequitability as indicated by salary comparisons within those paid by others in the labor market area; Section 3. That equitability of salaries shall be that which the City of Cupertino pays at its Step 3 of the pay range when said amount approxi- mates the median of the mid-points of the salary ranges in effect for the other cities in the labor market area; ~ ~ ~ Section 4. That an exception to said general wage and salary standards be requested to permit the rewarding of outstanding service through the granting of inerit increases, which increases when paid by other cities are recorded as longevity in grade step increases and as such are excluded from the said general wage and salary standards; Section 5. That permission be requested of the Pay Board for an effective approval date of June 28, 1972 to be applied to the aforementioned requests for exception. Frolich City Clerk Mayor, City of Cupertino -2- RESOLUTION N0. 3298 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO APPROVING THE IMPROVEMENT OF FRONTAGE AT 22765 SAN JUAN ROAD; TZE VEE HUANG AND ESTHER W. HUANG: AUTHORIZING THE CITY ENGINEER TO SIGN THE FINAL PLAN: AND AUTHORIZING EXECUTION OF AGREEMENT IN CONNECTION THEREWITH WHEREAS, there has been presented to the City Council an agreement for the improvement of the street frontage at 22765 San Juan Road by Tze Vee Huang and Esther W. Huang; and WHEREAS, said proposed agreement contains provisions for the construc- tion of streets, curbs, gutters, sidewalks, and for other improvements with- in a period of three years and six months from the date of execution of said agreement, and sufficient bonds having been presented for the faithful per- formance of said work and the carrying out of said agreement; and said agree- ment and bonds having been approved by the City Attorney; NOW, THEREFORE, BE IT RESOLVED that said agreement for the improvement of street frontage at 22765 San Juan Road be hereby approved; and the City Engineer is hereby authorized to sign the final plans when presented by the developer; and the Mayor and the City Clerk are hereby authorized to execute the agreement herein referred to in behalf of the City of Cupertino.
