• A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO CALLING A
PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY,
OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT
ON THE EAST SIDE OF SARATOGA-SUNNYVALE ROAD FROM SOUTH SIDE OF
STEVENS CREEK BOULEVARD TO A POINT APPROXIMATELY 1800 FEET NORTH, IN
CONNECTION WITH CROSSROADS ASSESSMENT DISTRICT PROJECT N0. 71-2
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF CUPERTINO AS FOLLOWS:
WHEREAS, Ordinance No. 474 establishes a procedure for the creation of
underground utility districts and requires as the initial step in such proced-
ure the holding of a public hearing to ascertain whether public necessity,
health, safety, or welfare requires the removal of poles, overhead wires and
associated overhead structures and the underground installation of wires and
facilities for supplying electric, communication, or similar or associated
service in any such district; and
WHEREAS, substantial advantage exists in the effort to extend the program
for removal of overhead utilities along the easterly side of Saratoga-Sunnyvale
Road between Stevens Creek Boulevard and a point approximately 1800 feet nor-
therly thereof; and
WHEREAS, benefits include the ability to obtain credits toward the overall
costs under State Public Utilities Commission regulations; and
WHEREAS, adoption of an underground district will provide means of extend-
ing the scope of work undertaken in conjunction with Crossroads Assessment Dis-
trict Unit l; and
WHEREAS, the adoption of said district will provide an equitable means
of effecting the removal of overhead lines facilitating reimbursement in the
Crossroads Assessment District Unit 1 for expenses incurred benefiting the
owners of said district;
NOW, THEREFORE, BE IT RESOLVED as follows:
l. NOTICE IS HEREBY GIVEN that a public hearing will be held by the
City Council of the City of Cupertino on January 2, 1973, at the
hour of 7:30 p.m. in the Council Chamber of the City Hall, Cuper-
tino, California, to ascertain whether the public necessity, health,
safety or welfare requires the removal of poles, overhead wires
and associated overhead structures and the underground installation
of wires and facilities for supplying electric, communication, or
similar associated service in the District hereinabove described.
2. At such hearing all persons interested shall be given an opportunity
to be heard. Said hearing may be continued from time to time as
may be determined by the City Council.

3. The City Clerk shall notify all affected property owners as
shown on the last equalized assessment roll and utilities
concerned of the time and place of such hearing by mailing a
copy of this Resolution to such property owners and utilities
concerned at least ten (10) days prior to the date thereof.
4. The area proposed to be included in the District is shown upon
that certain map entitled PROPOSED BOUNDARY UNDERGROUND UTILITY
DISTRICT, dated November 30, 1972, which is on file in the of-
fice of the City Clerk of the City of Cupertino.
PASSED AND ADOPTED at a regular meeting of the City Council of the City
of Cupertino this 4th day of December , 1972, by the following vote:
AYES: Councilmen - Jackson, Meyers, Sparks, Irwin
NOES: Councilmen - None
ABSENT: Councilmen -- Frolich
