A RESOLUTION Or PRELIMII~rARY APPROVAL OF ENGINEER'S REPORT
BLANEY A_VENUE, ET AL. STREE':I' WIDENING PROJECT
ASSESSMENT DISTRICT AU 70-1
RESOLVED, by the City Council of the City of Cupertino,
California, that
WHEREAS, on the 21st day of December, 1970, this Council
~ did~adopt its Resolution of Intention No. 3000, to acquire and
construct improvemEnts in said City, and did refex the proposed
acquisitions and improvements to the Director of Publ.ic Works,
he being the officer havir~g charge and cont;rol of the acquisi-
tion and construction of public improvements in and for said
City of the kin~3 described therein and being a competent person ~
employed by said City for that purpose, and did therein direct
said. Director of Public Works to make and file with tlze City
Clerk of this City a report in writing; a11 as therPin moxe
particularly described, under and pursuant to the Muni~ipaZ ~
Improvement Act of 1g13; . ~
WHEREAS, said Director of Public Works has rnade and filed
with the City ~C]_erk a report in writin~ as ca~.led for in said
Resolution of Intention and under and pursuant to said Act,
~ which report has been presented to this Council for consiaeration;
WHEREAS, this Council has duly considered said report and
each and every part thereof, and finds th~.t each and everv part
of said report is sufficient, and that r~eith~r sai~ repor•t nor
any part thereof requires or should be modified in any respect;
NOW,.THEREFORE, IT~IS ORDEREn, as follows:
l. That the plans and specific~tions For the proposed
improvements to be made, contained in said report, be, and they
are hereby preliminarily approved and confirmed.
2. That the Engineer's estimate of the itemized an6 tota~
costs and expenses of said acquisitions and improvements arid of
the incidental expenses in connection therewith, contair~ea in said
report, be, and each of them are hereby prelim'inarily approved
and confirmed.
3. That the diagram showin~ the assessment district re- ~
ferred to and described in said Resolution~of Inr,ention, and
also the boundaries and dimensions of the respective subdivisions
of land within said assessment district as the same exi~ted at
. the time of the passage of said Resolution of Intention, each of
whicr. subdivisions have been given a separate nurr~ber upon said
diagram, as cuntained ir. said report, be, and i.t is hereby pre-
liminarily approved and confirmed. .
4. That the proposed assessments upon the several sub-
divisions of land in said assessment district in proportion to
the estimated benefits to be received by such subdivisions,
respectively, from said acquisitions and improvements, and of
the incidental expenses thereof, as contained in said report,
be, and they are hereby preliminarily approved and confirmed.
5. That the maps and descriptions of the lands and
easements to be acquired, as contained in said report, be, and
the same are hereby preliminarily approved..
6. That said report shall stand as the Engineer's
report for the purpose of all subsequent proceedings had pur-
suant to said Resolution of Intention.
PASSED AND ADOPTED at a regular meeting of the City Council
of the City of Cupertino this 17th. day of May, 1971, by the
following vote:
